【摘要】： 以1941年12月8日太平洋戰(zhàn)爭爆發(fā)為分水嶺,外國勢力對上海公共租界的爭奪在此前后發(fā)生了急劇的變化。太平洋戰(zhàn)爭爆發(fā)之前,公共租界是英美列強(qiáng)侵略中國的主要基地,有著強(qiáng)大的西方勢力和影響。而在太平洋戰(zhàn)爭爆發(fā)之后,日軍的武力入侵使得西方列強(qiáng)在此“苦心”經(jīng)營了近一百年的租界特權(quán)喪失殆盡。對此,本文著力探討的是,在太平洋戰(zhàn)爭爆發(fā)之后,公共租界法制在日本侵略軍的直接控制下發(fā)生了怎樣的變化?其特點(diǎn)如何?影響怎樣?當(dāng)時(shí)的公共租界工部局,在“日偽”這一特殊歷史時(shí)期中扮演了一個(gè)什么樣的角色?這些都是本文試圖回答的問題。 本文包括了導(dǎo)言、正文和結(jié)語三個(gè)部分。其中,正文又分為三章。 導(dǎo)言部分,筆者首先對本文所指的“日偽時(shí)期”進(jìn)行了時(shí)間上的界定,以明確本文研究的時(shí)間范圍。然后從選題的目的出發(fā),闡明本文的研究價(jià)值與意義所在。最后,筆者就與本文相關(guān)的學(xué)術(shù)文獻(xiàn)和研究現(xiàn)狀進(jìn)行了簡要的說明,并介紹了本文所使用的史料來源。 正文部分,第一章主要介紹日偽時(shí)期上海公共租界法制機(jī)構(gòu)的變異。在這一章中,筆者分別從立法機(jī)構(gòu)、警務(wù)機(jī)構(gòu)和審判機(jī)構(gòu)入手,對各機(jī)構(gòu)在日偽時(shí)期的人事變動(dòng)進(jìn)行了著重考察,從中可以看出這種變異背后所體現(xiàn)出的權(quán)力角逐的結(jié)果。 第二章主要介紹日偽時(shí)期上海公共租界法制內(nèi)容的變異。日本帝國主義為適應(yīng)其侵略戰(zhàn)爭的需要在淪陷區(qū)強(qiáng)力實(shí)行法西斯殖民統(tǒng)治,使得這一時(shí)期的法制內(nèi)容帶有明顯的殖民痕跡。有鑒于此,筆者在史料的基礎(chǔ)上,通過對日偽時(shí)期公共租界內(nèi)浩繁如織的法令進(jìn)行整理和歸納,分政治高壓、經(jīng)濟(jì)掠奪和戰(zhàn)時(shí)管制三大類,對日偽戰(zhàn)時(shí)殖民地法制進(jìn)行詳細(xì)介紹。 最后一章即第三章,是在分析第一、二章的基礎(chǔ)上進(jìn)行理論升華,通過對比、歸納和分析,概括出日偽時(shí)期上海公共租界法制變異后的特點(diǎn)及其影響,并據(jù)此得出最終結(jié)論。
[Abstract]:With the outbreak of the Pacific War in December 8th 1941 as the watershed, the competition for Shanghai public concession by foreign forces changed dramatically before and after the Pacific War broke out. The public concession was the main base for the British and American powers to invade China, with strong Western influence and influence. And after the outbreak of the Pacific War. The Japanese armed invasion has made the Western powers "painstakingly" manage in this area for nearly 100 years of the loss of concession privileges. For this, this paper focuses on the Pacific War after the outbreak. How did the legal system of public concessions change under the direct control of the Japanese invading army? What are their characteristics? What's the impact? What role did the Public concession and Industry Bureau play in the special historical period of "Japanese Puppet" at that time? These are the questions this paper tries to answer. This paper includes three parts: introduction, text and conclusion. Among them, the text is divided into three chapters. In the introduction part, the author defines the "period of the Japanese pseudo-period" in order to define the time range of the study, and then proceed from the purpose of the topic. Finally, the author gives a brief explanation of the relevant academic documents and research status, and introduces the sources of historical materials used in this paper. The main body part, the first chapter mainly introduces the variation of the legal system of Shanghai public concession during the period of Japanese and puppet. In this chapter, the author starts with the legislature, the police organ and the judicial institution respectively. The personnel changes of various organizations during the period of Japanese and puppet are investigated emphatically, from which we can see the result of power struggle embodied in this kind of variation. The second chapter mainly introduces the variation of the contents of the legal system of Shanghai public concession during the period of Japanese-puppet period. In order to meet the need of its aggressive war, Japanese imperialism enforced fascist colonial rule in the enemy-occupied areas. The legal system of this period with obvious colonial traces. In view of this, the author on the basis of historical data, by sorting out and summarizing the numerous decrees in the public concessions during the period of Japanese and puppet, political pressure. The economic plunder and wartime control are introduced in detail. The last chapter, the third chapter, is based on the analysis of the first and second chapters of the theoretical sublimation, through comparison, induction and analysis, summed up the changes in the legal system of Shanghai public concession in the period of Japan and the impact of the characteristics. Based on this, the final conclusion is drawn.
