【摘要】： 推行社區(qū)矯正制度是我國(guó)當(dāng)前司法體制改革中引人注目的一項(xiàng)重要內(nèi)容。隨著國(guó)家人權(quán)事業(yè)的逐步發(fā)展,保障社區(qū)矯正對(duì)象的權(quán)利成為人權(quán)保護(hù)的題中之義。本文認(rèn)為,加強(qiáng)社區(qū)矯正對(duì)象的權(quán)利保障是刑罰“人道”、“輕緩”、“文明”理念的要求,是人權(quán)保護(hù)的要求,是提高矯治犯罪效果的要求。社區(qū)矯正對(duì)象的權(quán)利具有有限性、獨(dú)特性、不穩(wěn)定性和廣泛性的特點(diǎn)。社區(qū)矯正對(duì)象的人身權(quán)利、政治權(quán)利、社會(huì)經(jīng)濟(jì)權(quán)利和法律救助權(quán)利應(yīng)當(dāng)?shù)玫匠浞值谋Ｕ�。社區(qū)矯正對(duì)象的權(quán)利保障工作應(yīng)遵循法治原則、以人為本、適度原則和分類處遇等四個(gè)準(zhǔn)則,實(shí)踐中要從加強(qiáng)立法保障、執(zhí)法和司法保障、組織保障、社會(huì)保障和監(jiān)督保障等五個(gè)方面,促進(jìn)社區(qū)矯正對(duì)象權(quán)利保障事業(yè)的發(fā)展。
[Abstract]:Carrying out the community correction system is an important content in the current judicial system reform in China. With the gradual development of the national human rights cause, the protection of the right of the community correction object becomes the meaning of the human rights protection. Strengthening the protection of the right of the community correction object is the demand of the concept of "humanity", "mild" and "civilization" of penalty, the requirement of human rights protection and the requirement of improving the effect of crime correction. The right of the community correction object is limited and unique. The characteristics of instability and universality. The personal, political, social and economic rights and the right to legal aid of the objects of community correction should be fully safeguarded, and the protection of the rights of the objects of community correction should follow the principle of rule of law. In practice, it is necessary to strengthen legislative protection, law enforcement and judicial protection, organizational security, social security and supervision and security. To promote the development of community correction object rights protection.
