【摘要】：正現(xiàn)代社會(huì)之后,法律將理性和自由主義的維度引進(jìn)到了侵權(quán)法律領(lǐng)域:就個(gè)體的人而言,每個(gè)人都是一個(gè)理性的存在,他可以為了自己的利益充分發(fā)揮自己的才能、獲取自然的和勞動(dòng)的回饋。與"自由"相關(guān)的詞匯,一是freedom,一是liberty。詞源學(xué)上,兩詞分別追溯到拉丁語系和日耳曼語系。Freedom指向自由的狀態(tài),與奴役和壓迫相對(duì),羅斯福的言論表達(dá)、宗教信仰、免于匱乏和免于恐懼的"四大自由",即是此意。Liberty則指向法律的權(quán)利,與義務(wù)和責(zé)任相對(duì),美國《獨(dú)立
