文獻名稱：“封堵高考移民”現(xiàn)象的法理分析

    前言：“高考移民”是現(xiàn)代社會中的一個特殊人群,近來,各地紛紛出臺相關政策封堵“高考移民”。但一味的“封堵”并不能從根本上解決問題,所以必須轉(zhuǎn)變思路,從完善法規(guī)、加強立法、發(fā)揮司法作用著手。從法理分析角度質(zhì)疑“封堵”,提出解決“高考移民”現(xiàn)象法律規(guī)制的三個途徑:一是完善憲法,使教育平等權在憲法中得到確認;二是加快國家立法步伐;三是發(fā)揮司法機關在監(jiān)督行政和保護考生權利方面的作用。
    ″The emigrants of the national examination″ is a special group in the modern society. Recently, many districts put forward the policies to prevent such emigration. However, the issues can t be solved only through restraint, we must change the way of thinking, from improving the constitution, strengthening the lawmaking, exerting judicial function.
