【摘要】：自由作為根本道德價(jià)值固然值得珍視,但是其運(yùn)用依然需要受到限制甚至強(qiáng)制。遵循普遍的道德法則來保持自由的存在并增進(jìn)其實(shí)現(xiàn)的可能,這一價(jià)值取向乃是康德確立法權(quán)學(xué)說的根本出發(fā)點(diǎn)。道德命令(分別表現(xiàn)為法權(quán)義務(wù)和德性義務(wù))乃是為了確保每個(gè)人的自由與其他任何人的自由都能夠在普遍原則之下得以存續(xù)和提升,所有人因此能夠在一定的限制條件下自由追尋合理的目的。盡管道德法則在具體運(yùn)用中呈現(xiàn)出外在強(qiáng)制和自我限制的雙重面向,但是基于"融貫論"的解讀方式,康德法權(quán)學(xué)說及其蘊(yùn)含的強(qiáng)制性特征直接源于普遍性的道德命令和人自身即是目的這一價(jià)值旨趣,進(jìn)而為維護(hù)和增進(jìn)自由價(jià)值確立前提條件。在此意義上,純粹實(shí)踐理性及其表征的自由價(jià)值乃是證成法權(quán)原則的規(guī)范性前提,也區(qū)別于經(jīng)由慎思理性確立權(quán)利和主權(quán)原則的社會(huì)契約論傳統(tǒng)。質(zhì)疑此完備性自由主義思路的"分離論"觀點(diǎn)割裂了個(gè)體自主和公共自主的關(guān)聯(lián),從而難以展現(xiàn)康德道德形而上學(xué)的完整形態(tài)和根本意圖,也會(huì)導(dǎo)致在政治正當(dāng)性論證中出現(xiàn)諸多缺失。
[Abstract]:Freedom as a fundamental moral value should be cherished, but its application still needs to be restricted or even enforced. Follow the universal moral law to maintain the existence of freedom and enhance the possibility of its realization. This value orientation is the fundamental starting point of Kant's doctrine of positive legislative power. The moral imperative (expressed as the duty of law and duty of virtue) is to ensure that the liberty of everyone and that of anyone else is universal. Be able to survive and promote under the principle, Therefore, all people are free to pursue reasonable purpose under certain restrictive conditions. Although the application of moral law presents the dual orientation of external compulsion and self-restriction, it is based on the interpretation of "the theory of coherence". Kant's doctrine of right of law and its mandatory characteristics are directly derived from the universal moral order and the value purport of human being as the purpose, and then establish the precondition for maintaining and promoting the value of freedom. In this sense, The free value of pure practical reason and its representation is the normative premise of the principle of legal power. It is also different from the tradition of social contract theory, which establishes the principle of rights and sovereignty through careful thinking. The theory of "separation", which questions the idea of complete liberalism, separates the relationship between individual autonomy and public autonomy. Therefore, it is difficult to show the complete form and fundamental intention of Kant's moral metaphysics, which will lead to many defects in the demonstration of political legitimacy.
