【摘要】：目的:探討新藥、仿制藥與進(jìn)口藥不同技術(shù)轉(zhuǎn)讓時(shí)機(jī)的風(fēng)險(xiǎn)、利弊與應(yīng)對(duì)策略,為醫(yī)藥企業(yè)發(fā)展戰(zhàn)略的提升提供依據(jù)。方法:根據(jù)與藥品注冊(cè)和轉(zhuǎn)讓有關(guān)的規(guī)定,分析新藥、仿制藥與進(jìn)口藥注冊(cè)申請(qǐng)過(guò)程中可轉(zhuǎn)讓的項(xiàng)目,探討其相應(yīng)的轉(zhuǎn)讓時(shí)機(jī)及風(fēng)險(xiǎn),并提出應(yīng)對(duì)策略。結(jié)果與結(jié)論:藥品注冊(cè)過(guò)程中可轉(zhuǎn)讓的項(xiàng)目包括知識(shí)性產(chǎn)權(quán)(專利權(quán)、專利申請(qǐng)權(quán)、技術(shù)秘密、申請(qǐng)資料、未披露數(shù)據(jù)等)與權(quán)力性產(chǎn)權(quán)(臨床批件、新藥證書(shū)、藥品批準(zhǔn)文號(hào)、醫(yī)藥產(chǎn)品注冊(cè)證、進(jìn)口產(chǎn)品注冊(cè)證等)。藥品技術(shù)轉(zhuǎn)讓有4個(gè)時(shí)機(jī),時(shí)機(jī)1為轉(zhuǎn)讓方在完成藥理學(xué)、毒理學(xué)等臨床前研究后,申請(qǐng)臨床批件前;時(shí)機(jī)2為轉(zhuǎn)讓方取得臨床批件后,啟動(dòng)臨床試驗(yàn)前;時(shí)機(jī)3為新藥技術(shù)轉(zhuǎn)讓;時(shí)機(jī)4為藥品生產(chǎn)技術(shù)轉(zhuǎn)讓。新藥有4個(gè)轉(zhuǎn)讓時(shí)機(jī),仿制藥與進(jìn)口藥在時(shí)機(jī)1、2、4可進(jìn)行轉(zhuǎn)讓。不同時(shí)機(jī)的轉(zhuǎn)讓風(fēng)險(xiǎn)與利益各不相同,隨著藥品注冊(cè)進(jìn)程推進(jìn),風(fēng)險(xiǎn)逐漸降低,但創(chuàng)新性也隨之降低。企業(yè)應(yīng)結(jié)合政策、市場(chǎng)和自身特點(diǎn)選擇合適的產(chǎn)品和轉(zhuǎn)讓時(shí)機(jī)。
[Abstract]:Objective: to explore the risks, advantages and disadvantages of different technology transfer opportunities, advantages and disadvantages of new drugs, generic drugs and imported drugs, and to provide the basis for the development strategy of pharmaceutical enterprises. Methods: according to the regulations related to the registration and transfer of drugs, the transferable items in the application for registration of new drugs, generic drugs and imported drugs were analyzed, the corresponding transfer opportunities and risks were discussed, and the countermeasures were put forward. Results & conclusion: the transferable items in the process of drug registration include intellectual property right (patent right, patent application right, technical secret, application information, undisclosed data, etc.) and power property right (clinical approval, new drug certificate, etc.) Drug approval number, pharmaceutical product registration certificate, import product registration certificate, etc. There are 4 opportunities for the transfer of drug technology: 1) before the transferee applies for clinical approval after the completion of preclinical studies such as pharmacology and toxicology, 2) before the clinical trial is initiated after the transferee has obtained the clinical approval; Opportunity 3 is new drug technology transfer, opportunity 4 is drug production technology transfer. New drugs have four opportunities to transfer, and generic drugs and imported drugs can be transferred at time 1 / 2. The transfer risk and benefit are different in different time. With the progress of drug registration, the risk is gradually reduced, but the innovation is also reduced. Enterprises should combine policy, market and their own characteristics to choose the right product and transfer time.
