【摘要】：目的探討在我國放開藥品批準文號申請及轉(zhuǎn)讓的制度可行性并提出建議。方法采用文獻閱讀法、專家咨詢法及實例舉證法等分析我國對于藥品批準文號限制管理的現(xiàn)狀及影響。結(jié)果我國僅限藥品生產(chǎn)企業(yè)申請獲得藥品批準文號,并且不允許文號在市場上轉(zhuǎn)讓,實際限制了藥品技術(shù)的有效流通,違背了客觀規(guī)律,造成一定程度上的資源浪費及監(jiān)管負擔。結(jié)論在醫(yī)藥產(chǎn)業(yè)市場亟待盤活的今天,在國務院授權(quán)部分省市開展藥品上市許可人制度試點的背景下,我國應逐步放開藥品批準文號的申請及轉(zhuǎn)讓,使其更加符合市場規(guī)律及科學創(chuàng)新監(jiān)管的需求。
[Abstract]:Objective to explore the feasibility of liberalizing the system of drug approval number application and transfer in China and to put forward some suggestions. This paper analyzes the current situation and influence of drug approval number restriction management in China by expert consultation method and case proof method. As a result, only drug manufacturing enterprises in China are allowed to apply for drug approval number and are not allowed to transfer the document number in the market. It actually limits the effective circulation of pharmaceutical technology, violates the objective law, and results in a certain degree of waste of resources and supervision burden. Under the background that some provinces and cities are authorized by the State Council to carry out the trial of drug listing licensor system, our country should gradually open up the application and transfer of drug approval number, so as to make it more in line with the market law and the need of scientific innovation and supervision.
