【摘要】：據(jù)世界衛(wèi)生組織報告表明，目前人類總體生殖能力明顯低于上世紀四五十年代，如今世界范圍內(nèi)已有超過15%的夫婦深受不孕不育的困擾。在此背景下，輔助生殖技術應運而生，作為傳統(tǒng)自然生殖方式的重要補充，為不孕不育者帶來福音。但科學技術是把雙刃劍，輔助生殖技術給生育困境中的人們帶來福利的同時，也引起一系列社會問題，主要圍繞在生命商品化、生育商業(yè)化、婚姻家庭倫理關系復雜化、性道德及人格的滑坡等方面。目前世界各國普遍重視輔助生殖技術立法，西方已初步建立起相對完善的輔助生殖技術法律體系，東方國家也在加快立法進程，而實際情況是，哪里有輔助生殖技術，哪里便會責聲四起，這從本質(zhì)上來說，是高新科技與傳統(tǒng)思維矛盾沖突的產(chǎn)物。 筆者認為，東西方存在巨大的文化差異，法律是廣義文化的組成部分，所以研究法律問題，，從法律運行的外部環(huán)境入手是較為合理的一種方法，將技術問題從文化層面進行分析也更具反思性。在此指導思想下，本文分四章內(nèi)容進行論述。首先概述了輔助生殖技術的種類及其應用與發(fā)展情況，然后整理兩大法系的輔助生殖技術法律法規(guī)，并比較異同，最后對歐美和我國輔助生殖技術法律法規(guī)背后的文化根源進行探究，挖掘儒家、佛教、基督教、移民文化、女性主義視域下的東西方文化因素與現(xiàn)行輔助生殖技術法律法規(guī)的內(nèi)在聯(lián)系。本文認為固有傳統(tǒng)觀念對生殖技術的立法有阻礙作用，隨著社會的變遷我們呼吁新倫理的到來，輔助生殖技術的立法也需要更多的人文關懷，只有科學精神與人文精神真正融合，法律才能被更多人信仰，科技才能更好為人類服務，社會才會更加和諧。
[Abstract]:According to the World Health Organization, the overall reproductive capacity of human beings is significantly lower than that of the 1940s and 1950s, and more than 15 percent of couples worldwide are suffering from infertility. In this context, assisted reproductive technology came into being, as an important supplement to traditional natural reproduction, bringing gospel to infertile people. But science and technology is a double-edged sword, assisted reproductive technology to bring benefits to the people in reproductive distress, but also caused a series of social problems, mainly around the commercialization of life, fertility commercialization, marriage and family ethical relations complex. The decline of sexual morality and personality. At present, countries all over the world generally attach importance to the legislation of assisted reproductive technology. The western countries have initially established a relatively perfect legal system of assistive reproductive technology, and the eastern countries are also speeding up the legislative process. However, the actual situation is, where is the assisted reproductive technology? This is essentially a conflict between high-tech and traditional thinking. The author believes that there is a huge cultural difference between the East and the West, and that law is a part of broad culture, so it is a more reasonable method to study legal problems and start with the external environment of law operation. It is also more reflective to analyze technical issues from a cultural perspective. In this guiding ideology, this paper is divided into four chapters to discuss. First of all, it summarizes the types of assisted reproductive technology, its application and development, and then collates the laws and regulations of assisted reproductive technology in the two legal systems, and compares the similarities and differences. Finally, it explores the cultural roots behind the laws and regulations of assisted reproductive technology in Europe, America and China, and excavates the culture of Confucianism, Buddhism, Christianity and immigration. The inner relationship between the western and eastern cultural factors and the existing laws and regulations of assisted reproductive technology in the view of feminism. This paper holds that the inherent traditional concept has an obstacle to the legislation of reproductive technology. With the change of society, we call for the arrival of new ethics, and the legislation of auxiliary reproductive technology also needs more humanistic care. Only when the spirit of science and humanism are really combined, can the law be believed by more people, science and technology can serve mankind better, and the society will be more harmonious.
