【摘要】：法律語篇是一種社會過程,通過合理分布人際語義資源來促進各類社會過程的體現(xiàn)。分析表明,立法語篇小句主語分布于自域、私域、公域內(nèi),域與域之間充分體現(xiàn)合作性,其情態(tài)資源使用體現(xiàn)同化性。律師代理詞對話壓縮與擴展資源使用特征體現(xiàn)順應(yīng)性過程。庭審語篇協(xié)商資源使社會成員得以最大化地擴張己方利益、壓縮對方利益,從而凸顯了競爭與沖突性。不同類型法律語篇通過合理應(yīng)用各種人際語義資源,體現(xiàn)同化、合作、順應(yīng)、競爭和沖突等社會過程,從而實現(xiàn)社會合理競爭,協(xié)調(diào)社會沖突,促進社會發(fā)展。
[Abstract]:Legal discourse is a kind of social process, which promotes the embodiment of various social processes through the rational distribution of interpersonal semantic resources. The analysis shows that the subject of legislative clauses is distributed in the domain, private domain, public domain, the cooperation between the domain and the domain, and the use of modal resources reflects the assimilation. The process of adaptation is embodied in the compression and expansion of the use of resources. The negotiation resources of trial discourse enable the members of the society to maximize their own interests and compress the interests of the other party, thus highlighting the competition and conflict. Through the rational use of various interpersonal semantic resources, different types of legal texts embody the social processes of assimilation, cooperation, adaptation, competition and conflict, so as to achieve reasonable social competition, coordinate social conflicts and promote social development.
