【摘要】： 在中國(guó),實(shí)體音樂盜版率已超過90%,而數(shù)字音樂盜版率已超過99%。中國(guó)是世界各地國(guó)際反盜版組織打擊音樂盜版的目標(biāo)排名的前幾位。在本文中,我們將研究音樂盜版的后果,音樂盜版的原因,及打擊音樂盜版的行為。 首先,我們從審查音樂盜版的文獻(xiàn)的幾個(gè)觀點(diǎn)開始:1我們調(diào)查了音樂盜版所帶來的經(jīng)濟(jì)影響。2我們介紹了版權(quán),著作權(quán)法和侵犯版權(quán)的定義。3我們調(diào)查了現(xiàn)有的音樂格式如何使音樂盜版普遍。4我們描述了互聯(lián)網(wǎng)的音樂盜版模式,它的特點(diǎn)及其相關(guān)的案例。5我們描述了實(shí)體盜版的模式,它的特點(diǎn)及其相關(guān)的案例。6我們描述了社會(huì)因素和經(jīng)濟(jì)因素如何影響音樂盜版。7在做完了文獻(xiàn)回顧后,我們嘗試尋找會(huì)影響音樂盜版率的因素的相互關(guān)系。我們把這些因素分成六個(gè)自變數(shù)。在我們的假設(shè)中,我們發(fā)現(xiàn)盜版音樂的產(chǎn)品特性及實(shí)體音樂盜版環(huán)境對(duì)音樂盜版率有交互關(guān)系。合法音樂產(chǎn)品的特點(diǎn),互聯(lián)網(wǎng)音樂產(chǎn)品的環(huán)境,法律環(huán)境,消費(fèi)者的態(tài)度和看法被假設(shè)為中介變數(shù)。在我們的回歸分析中,我們發(fā)現(xiàn)音樂盜版產(chǎn)品的特點(diǎn)及互聯(lián)網(wǎng)音樂產(chǎn)品的環(huán)境及實(shí)體音樂盜版環(huán)境直接影響音樂盜版率。8在最后,我們討論了音樂盜版在發(fā)達(dá)國(guó)家和在中國(guó)的相似及不同處。我們最后還依照了文獻(xiàn)調(diào)查及問卷調(diào)查做了建議。
