【摘要】：近幾年，隨著流動(dòng)人口的增加和房?jī)r(jià)的攀升，為了解決最基本的居住問(wèn)題和商業(yè)房屋使用問(wèn)題,房屋租賃法律關(guān)系越來(lái)越頻繁的運(yùn)用到人們的生活的各個(gè)方面。實(shí)踐中，承租人為了滿足其家庭生活或商業(yè)運(yùn)營(yíng)的需要，一般會(huì)對(duì)所租賃房屋進(jìn)行裝修，當(dāng)租賃合同屆滿、合同解除或無(wú)效等情況發(fā)生時(shí)，當(dāng)事人雙方關(guān)于裝飾裝修物的爭(zhēng)議越來(lái)越多，對(duì)此爭(zhēng)議的處理已經(jīng)成為司法實(shí)踐中一個(gè)亟待解決的問(wèn)題。 房屋租賃活動(dòng)中產(chǎn)生的裝修物，一方面來(lái)說(shuō)，在物權(quán)方面，其獨(dú)立于當(dāng)事人雙方之間的租賃關(guān)系，另一方面，就債權(quán)來(lái)說(shuō)又屬于合同的一部分。這就需要分別從物權(quán)和債權(quán)層面對(duì)其進(jìn)行準(zhǔn)確的區(qū)分，否則，就可能導(dǎo)致對(duì)二者的混淆，不利于合同當(dāng)事人雙方利益的平衡。此外，由于在立法和司法解釋上缺乏統(tǒng)一的規(guī)定，法官在審判這類(lèi)案件時(shí)，因沒(méi)有法律依據(jù)導(dǎo)致司法實(shí)踐中審判結(jié)果的混亂，從而也不能很好的保障承租人或出租人的合法權(quán)益，不利于正常司法活動(dòng)和社會(huì)經(jīng)濟(jì)的健康發(fā)展。鑒于租賃中產(chǎn)生的裝飾裝修物糾紛關(guān)系到社會(huì)不特定人員的利益，應(yīng)借鑒域外立法中有關(guān)解決房屋租賃合同中裝飾裝修物的相關(guān)規(guī)定，結(jié)合我國(guó)的現(xiàn)實(shí)情況，對(duì)我國(guó)房屋租賃合同中裝飾裝修物爭(zhēng)議的相關(guān)法律法規(guī)進(jìn)行研究，提出相關(guān)完善建議，以期對(duì)實(shí)踐中此類(lèi)糾紛的處理給出適用方法。 本文擬首先通過(guò)對(duì)裝飾裝修物的界定及特點(diǎn)的研習(xí)，分析裝飾裝修物與合同二者之間的關(guān)系。其次，，通過(guò)對(duì)法釋[2009]11號(hào)的研習(xí)評(píng)論及國(guó)內(nèi)外現(xiàn)行立法在處理房屋租賃中裝飾裝修物歸屬的分析比較，指出我國(guó)相關(guān)的不足和國(guó)外在該方面的規(guī)定對(duì)我國(guó)的啟示。本文第四部分和第五部分重點(diǎn)討論區(qū)分在善意添附和惡意添附的情形下，裝飾裝修物的處理問(wèn)題，并結(jié)合不當(dāng)?shù)美�，損害賠償，侵權(quán)責(zé)任及合同效力的不同情況，得出相關(guān)建議，以期獲得理論支撐。
[Abstract]:In recent years, with the increase of floating population and the rise of house prices, in order to solve the most basic housing problems and commercial housing use problems, the legal relationship of housing lease is used more and more frequently in all aspects of people's life. In order to meet the needs of their family life or commercial operation, the lessee will generally decorate the leased house. When the lease contract expires, the contract is cancelled or invalid, the dispute on decoration and decoration between the parties is increasing. The settlement of this dispute has become an urgent problem in judicial practice. On the one hand, on the one hand, in terms of property rights, it is independent of the lease relationship between the parties, on the other hand, As far as claims are concerned, they are also part of the contract. This requires an accurate distinction between them from the aspects of real right and creditor's rights, otherwise, it may lead to confusion between the two parties, which is not conducive to the balance of the interests of both parties to the contract. Due to the lack of uniform provisions in legislation and judicial interpretation, when judges try such cases, the lack of legal basis leads to confusion of the judicial results in judicial practice, and thus the legitimate rights and interests of the lessee or lessor are not well protected. This is not conducive to normal judicial activities and the healthy development of social economy. We should draw lessons from the relevant provisions of the extraterritorial legislation to resolve the decoration and decoration items in the housing lease contract, and study the relevant laws and regulations concerning the decoration and decoration disputes in the housing lease contract in our country, in combination with the actual situation in our country. Put forward the relevant consummation suggestion, hope to give the suitable method to deal with this kind of dispute in practice. In this paper, first of all, through the study of the definition and characteristics of decoration and decoration, the relationship between decoration and contract is analyzed. Through the analysis and comparison of the study comments of the French interpretation [2009] 11 and the current legislation at home and abroad in handling the ownership of the decoration and decoration items in the housing lease, The author points out the deficiency of our country and the enlightenment to our country from the provisions of foreign countries. The fourth and fifth parts of this paper mainly discuss the problem of how to deal with decoration and decoration in the case of goodwill and malicious attachment, and combine with improper enrichment. Compensation for damages, tort liability and contract effectiveness of different situations, the relevant recommendations, in order to obtain theoretical support.
