【摘要】:房屋租賃現(xiàn)象在我國現(xiàn)階段社會經(jīng)濟(jì)生活中廣泛存在,承租人為了最大限度的提高租賃房屋的效能,往往對所租房屋進(jìn)行裝飾裝修,因此,產(chǎn)生關(guān)于房屋租賃中裝飾裝修物的歸屬及利益返還問題的糾紛,這也成為法院審判中的難題,該類案件的處理在理論界及審判實(shí)務(wù)界均引起了高度關(guān)注!蹲罡呷嗣穹ㄔ宏P(guān)于審理城鎮(zhèn)房屋租賃合同糾紛案件具體應(yīng)用法律若干問題的解釋》在吸收各級人民法院和學(xué)術(shù)界意見基礎(chǔ)上,確立了處理此類糾紛的規(guī)則,為實(shí)踐中解決房屋租賃中裝修裝飾物的歸屬及利益返還、損害賠償?shù)燃m紛提供了切實(shí)可行的法律依據(jù)。但法釋[2009]11號究竟確定了怎樣的原則,需要我們理性的思考。此問題的處理涉及到物權(quán)和債權(quán)兩大領(lǐng)域,關(guān)涉“添附”、“不當(dāng)?shù)美钡让穹ɡ碚?如何針對具體的實(shí)踐情況正確理解和適用上述民法理論并處理好它們相互間的關(guān)系,是法釋[2009]11號中相關(guān)規(guī)則得以貫徹執(zhí)行的重要基礎(chǔ)。本文首先以一個(gè)典型案例引出房屋租賃中裝飾裝修糾紛存在的問題,從而引出對房屋租賃合同中裝飾裝修物的概念、特征及分類的論述;其次,本文對法釋[2009]11號中相關(guān)規(guī)則并沒有體現(xiàn)用民法“添附”理論處理裝飾裝修物所有權(quán)歸屬問題,也沒有運(yùn)用民法“不當(dāng)?shù)美敝贫绕胶猱?dāng)事人間利益沖突問題進(jìn)行了評析;再次,本文介紹了民法中的“添附”理論和“不當(dāng)?shù)美敝贫?進(jìn)而論證了房屋租賃中裝飾裝修物糾紛中應(yīng)該適用這兩種制度,以及對怎樣合理適用進(jìn)行了論證和說明;最后,在前文對法釋[2009]11號中相關(guān)規(guī)則的評價(jià)和對“添附”理論和“不當(dāng)?shù)美敝贫妊芯康幕A(chǔ)上,提出了正確處理此問題的制度框架。本文立足于平衡出租人與承租人雙方的利益進(jìn)行探討,以期對司法實(shí)踐會有所意義。
[Abstract]:The phenomenon of house lease exists widely in the social and economic life of our country at the present stage. In order to maximize the efficiency of the rental house, the lessee often decorates the rented house, therefore, There is a dispute about the ownership of decoration and decoration and the return of interests in the lease of a house, which has also become a difficult problem in court trials. The handling of this kind of cases has aroused great concern in both the theoretical and judicial practice circles. "interpretation of some issues on the Application of Law in the trial of Urban Housing Lease contract disputes by the Supreme people's Court" in absorbing the people's Law at all levels. Based on the views of the Academy and the academic community, The rules of dealing with such disputes have been established, which provide a practical legal basis for resolving the disputes such as the attribution of decoration ornaments and the return of interests and compensation for damages in practice. However, the interpretation of the law [2009] 11 determines exactly what the principles are. It is necessary for us to think rationally. The handling of this problem involves two major fields: real right and creditor's right, and involves civil law theories such as "appended", "improper enrichment" and so on. How to correctly understand and apply the above civil law theory and deal with the relationship between them according to the concrete practice, It is an important basis for the implementation of the relevant rules in the interpretation [2009] 11. Firstly, this paper uses a typical case to lead to the problems existing in the decoration and decoration dispute in the housing lease, thus leading to the concept of decoration and decoration in the housing lease contract. Secondly, the relevant rules in the legal interpretation [2009] 11 do not reflect the theory of "addition" to the civil law to deal with the ownership of decorative decoration. It also does not use the civil law "improper enrichment" system to balance the conflicts of interest between the parties. Thirdly, this paper introduces the theory of "adding attachment" and the system of "improper enrichment" in the civil law. Then it proves that the two systems should be applied in the dispute of decoration and decoration in the housing lease, and how to apply them reasonably; finally, On the basis of the previous evaluation of the relevant rules in the legal interpretation [2009] 11 and the study of the theory of "addition" and the system of "improper enrichment", This paper bases on balancing the interests of the lessor and the lessee in order to be meaningful to the judicial practice.
