【摘要】：保護(hù)和傳承民間口頭文學(xué)具有重要的現(xiàn)實(shí)意義。民間口頭文學(xué)是民族精神的直接載體,具有極強(qiáng)的認(rèn)知價(jià)值,體現(xiàn)了文化的獨(dú)立性和多樣性,對(duì)于文化傳承具有重要意義。當(dāng)代的民間口頭文學(xué)保護(hù)經(jīng)歷了因整理而保護(hù)和為傳承而保護(hù)的兩個(gè)階段,取得了一定的成績(jī),但也存在著這一些突出矛盾和現(xiàn)實(shí)問題。在民間口頭文學(xué)保護(hù)過程中,應(yīng)注重恢復(fù)活態(tài)保護(hù)與傳承的方式,注重傳承主體的自我修復(fù)與更新功能,還原民間的自然文化場(chǎng)域,提倡遵循自身規(guī)律的保護(hù)與漸進(jìn)式發(fā)展的模式。要以一種長(zhǎng)遠(yuǎn)的可持續(xù)的視角關(guān)注保護(hù)問題,充分借助法律手段,尊重知識(shí)產(chǎn)權(quán)、尊重民間文藝傳承人的權(quán)益,保護(hù)口頭文學(xué)的使用途徑與價(jià)值,避免其遭到濫用或非法利用。
[Abstract]:Protecting and inheriting folk oral literature has important practical significance. Folk oral literature is the direct carrier of national spirit, which has a strong cognitive value, reflects the independence and diversity of culture, and plays an important role in cultural inheritance. The protection of contemporary folk oral literature has experienced two stages of protection because of arrangement and protection for inheritance, and has made certain achievements, but there are also some outstanding contradictions and practical problems. In the process of protecting folk oral literature, we should pay attention to the way of restoring the living state of protection and inheritance, pay attention to the self-repairing and renewing function of the main body of inheritance, and restore the natural and cultural field of the folk. To promote the protection and progressive development model following its own laws. We should pay attention to the protection problem from a long-term sustainable perspective, fully use legal means, respect intellectual property rights, respect the rights and interests of folk literature and art inheritors, protect the way and value of the use of oral literature, and avoid its abuse or illegal use.
