【摘要】：2015年被稱為我國(guó)互動(dòng)娛樂的“IP元年”,更確切的說(shuō),應(yīng)該是網(wǎng)絡(luò)文學(xué)的“IP元年”。作為IP的最大源頭,大量網(wǎng)絡(luò)文學(xué)作品改編成影視、動(dòng)漫、網(wǎng)游等作品,受到廣大網(wǎng)絡(luò)用戶的追捧,“IP熱”在持續(xù)升高。目前,由網(wǎng)絡(luò)文學(xué)產(chǎn)生的產(chǎn)業(yè)鏈對(duì)我國(guó)經(jīng)濟(jì)及產(chǎn)業(yè)的發(fā)展產(chǎn)生了重大影響,為國(guó)民經(jīng)濟(jì)的發(fā)展提供了新的渠道。因此,對(duì)網(wǎng)絡(luò)文學(xué)的版權(quán)保護(hù)也受到了社會(huì)各界人士的高度重視。然而,網(wǎng)絡(luò)文學(xué)跟傳統(tǒng)文學(xué)之間有很大的差別,開放性的網(wǎng)絡(luò)環(huán)境,人們可以盡情的使用互聯(lián)網(wǎng),但網(wǎng)絡(luò)文學(xué)的版權(quán)難以得到保護(hù)了。網(wǎng)絡(luò)用戶在網(wǎng)絡(luò)上閱讀的文學(xué)作品,這些網(wǎng)絡(luò)文學(xué)作品很多是盜版的。從網(wǎng)絡(luò)文學(xué)出現(xiàn)之日起,它的版權(quán)就慢慢遭到侵權(quán),隨著時(shí)間的推移,侵權(quán)現(xiàn)象越來(lái)越猖獗。網(wǎng)絡(luò)文學(xué)侵權(quán)行為給社會(huì)造成了很大的影響,網(wǎng)絡(luò)文學(xué)侵權(quán)行為給整個(gè)社會(huì)造成了巨大的經(jīng)濟(jì)損失,損害了網(wǎng)絡(luò)作者以及網(wǎng)絡(luò)平臺(tái)經(jīng)營(yíng)者的直接利益,更重要的是,使侵權(quán)行為蔓延擴(kuò)大,給數(shù)字文化創(chuàng)意產(chǎn)業(yè)帶來(lái)?yè)p害。因此,針對(duì)繁榮發(fā)展的網(wǎng)絡(luò)文學(xué)產(chǎn)業(yè),還有對(duì)網(wǎng)絡(luò)文學(xué)IP的全面開發(fā),對(duì)網(wǎng)絡(luò)文學(xué)進(jìn)行保護(hù)是有必要的。建立網(wǎng)絡(luò)文學(xué)的版權(quán)保護(hù)體系,可以更好的支持網(wǎng)絡(luò)文學(xué)的發(fā)展,為網(wǎng)絡(luò)文學(xué)的良好發(fā)展作出貢獻(xiàn)。
[Abstract]:2015 is called "the first year of IP" in our country's interactive entertainment, more precisely, it should be "the first year of IP" of network literature. As the biggest source of IP, a large number of network literary works adapted into film and television, animation, online games and other works, by the majority of network users, "IP craze" continues to rise. At present, the industrial chain produced by network literature has a great influence on the development of economy and industry of our country, and provides a new channel for the development of national economy. Therefore, the copyright protection of network literature has also been highly valued by people from all walks of life. However, there is a great difference between the network literature and the traditional literature. In the open network environment, people can use the Internet as much as they can, but the copyright of the network literature is difficult to be protected. Internet users read literature on the Internet, many of which are pirated. Since the emergence of network literature, its copyright has been infringed slowly, and with the passage of time, the phenomenon of copyright infringement is more and more rampant. The infringement of network literature has a great impact on the society. The infringement of network literature has caused enormous economic losses to the whole society, and has damaged the direct interests of network authors and network platform operators. More importantly, Make the tort spread and expand, to the digital cultural creative industry damage. Therefore, it is necessary to protect the network literature for the prosperous development of the network literature industry and the overall development of the IP of the network literature. The establishment of copyright protection system of network literature can better support the development of network literature and contribute to the good development of network literature.
