【摘要】：在論及德治和法治間的關(guān)系時,時下輿論往往習(xí)慣于將德治看作隱匿于威權(quán)政體中的話語,是對法治的破壞和扭曲。這種看法來源于人們的文化"前見"和對現(xiàn)代西方法治理論非理性的崇拜。事實上,法治一語并非純粹的舶來品,德治也不是毫無爭議的"地方性話語"。應(yīng)當(dāng)通過對比中西法文化背景下法治和德治的關(guān)系,以及各自的合法性、正當(dāng)性證成路徑,發(fā)掘西方話語體系下法治中的道德含量,發(fā)現(xiàn)東方語境中德治所蘊含的法規(guī)則意識。以此為基礎(chǔ),研論依法治國與以德治國相結(jié)合作為治國的方略,是在接續(xù)傳統(tǒng)基礎(chǔ)上國家治理合法性和正當(dāng)性的互洽證成。
[Abstract]:When discussing the relationship between the rule of virtue and the rule of law, public opinion is used to regard the rule of virtue as the discourse hidden in the authoritarian regime, which is the destruction and distortion of the rule of law. This view comes from people's cultural preconceptions and irrational adoration of modern western theory of rule of law. In fact, the term rule of law is not purely foreign, nor is rule of virtue an indisputable "local discourse". By contrasting the relationship between the rule of law and the rule of virtue in the cultural background of Chinese and Western France, as well as their legitimacy and legitimacy, we should explore the moral content of the rule of law in the western discourse system, and find out the consciousness of the rule of law contained in the rule of virtue in the oriental context. On this basis, the combination of the rule of law and the rule of virtue as the strategy of governing the country is the mutual consistent proof of the legitimacy and legitimacy of state governance on the basis of the continuation of the tradition.
