【摘要】:如何對(duì)待行政權(quán)力是人類社會(huì)的恒久話題,亦是行政法學(xué)的核心內(nèi)容。在行政法學(xué)理論中,與外部控制相比較而言,行政自我規(guī)制一直是飽受爭(zhēng)議的控權(quán)機(jī)制。近些年來(lái),由于行政任務(wù)的多元化和行政裁量權(quán)的急劇擴(kuò)張,外部控制顯得有些魯鈍,而行政自我規(guī)制卻呈現(xiàn)出方興未艾的發(fā)展態(tài)勢(shì)。行政自我規(guī)制在行政實(shí)踐中的迅猛發(fā)展,逐漸受到了行政法學(xué)者的關(guān)注,并對(duì)之進(jìn)行系統(tǒng)性地研究。然而,行政自我規(guī)制應(yīng)當(dāng)如何實(shí)現(xiàn),迄今為止還缺乏比較深入的研究成果,這種情形非常不利于行政自我規(guī)制理論的發(fā)展。因此,本論文主要是從行政組織視角展開(kāi)分析,探尋行政組織架構(gòu)中所蘊(yùn)含的自我規(guī)制基因,以及這些自我規(guī)制機(jī)制又是如何被虛置化了,進(jìn)而主張通過(guò)行政組織重構(gòu)來(lái)構(gòu)建行政自我規(guī)制的實(shí)現(xiàn)機(jī)制。本論文的研究目的主要體現(xiàn)為三個(gè)方面:一是針對(duì)行政法治實(shí)踐中大量存在的政府自我革命行為,從行政法學(xué)角度及時(shí)地作出回應(yīng);二是探尋有效控制行政權(quán)力的多元途徑,不斷完善行政權(quán)力的控制機(jī)制;三是為當(dāng)前我國(guó)的法治政府建設(shè)提供理論上的支撐。第一章主要是對(duì)行政組織的自我規(guī)制理論進(jìn)行闡述。論文首先對(duì)行政自我規(guī)制的基本理論進(jìn)行闡述,主要包括行政自我規(guī)制的概念、內(nèi)涵。然后論述了行政自我規(guī)制的正當(dāng)性基礎(chǔ),以及與法治政府之間的關(guān)系。接著論證了行政組織的基本架構(gòu)中所蘊(yùn)含的行政自我規(guī)制基因,以及行政自我規(guī)制如何被虛置化了。最后論文主張通過(guò)行政組織重構(gòu)來(lái)構(gòu)建行政自我規(guī)制的實(shí)現(xiàn)機(jī)制。第二章主要是闡述如何從優(yōu)化行政組織結(jié)構(gòu)方面來(lái)實(shí)現(xiàn)自我規(guī)制。這一章首先闡釋了行政組織結(jié)構(gòu)主要包括橫向結(jié)構(gòu)、縱向結(jié)構(gòu)和組織規(guī)模三個(gè)維度,這三者直接影響著行政組織結(jié)構(gòu)的形成。然后,基于行政組織法的相關(guān)規(guī)定,描述了我國(guó)行政組織結(jié)構(gòu)的現(xiàn)狀,重點(diǎn)分析了行政組織權(quán)分配、職責(zé)同構(gòu)、組織規(guī)模以及現(xiàn)代信息技術(shù)對(duì)行政組織結(jié)構(gòu)的影響等。最后論文提出通過(guò)行政任務(wù)導(dǎo)向、行政組織權(quán)適度分配、法治保障、精簡(jiǎn)效能等具體路徑,優(yōu)化行政組織結(jié)構(gòu)促進(jìn)行政自我規(guī)制的發(fā)展。第三章主要是闡述如何從合理配置行政職權(quán)方面來(lái)實(shí)現(xiàn)自我規(guī)制。這一章首先對(duì)行政職權(quán)配置予以界定,然后闡釋我國(guó)行政職權(quán)配置的現(xiàn)狀及問(wèn)題產(chǎn)生的原因。在此基礎(chǔ)上,結(jié)合我國(guó)行政體制改革的現(xiàn)實(shí)情況,構(gòu)建行政職權(quán)合理配置的多種路徑,主要包括權(quán)責(zé)一致、分權(quán)與制衡以及行政職權(quán)相對(duì)集中等具體途徑,進(jìn)而為合理配置行政職權(quán)提供些許有益的借鑒。論文最后還對(duì)當(dāng)前行政實(shí)踐領(lǐng)域的權(quán)力清單制度進(jìn)行論述,因?yàn)闄?quán)力清單制度是行政職權(quán)配置的制度實(shí)踐,有著代表性的意義。第四章主要是闡述如何從促進(jìn)行政組織協(xié)調(diào)方面來(lái)實(shí)現(xiàn)自我規(guī)制。這一章首先論述了行政組織協(xié)調(diào)的必要性,以及與行政自我規(guī)制的關(guān)系。行政組織之間相互依賴的加強(qiáng),以及行政任務(wù)的跨地區(qū)、跨部門屬性,是行政組織協(xié)調(diào)的時(shí)代背景。接著,根據(jù)行政組織協(xié)調(diào)手段的強(qiáng)制性程度,劃分為命令控制模式和契約控制模式,并闡述了二者之間的關(guān)系。契約控制作為一種新的協(xié)調(diào)機(jī)制,標(biāo)志著行政組織協(xié)調(diào)的現(xiàn)代轉(zhuǎn)向。論文最后闡述了行政組織協(xié)調(diào)在實(shí)踐中出現(xiàn)的新趨勢(shì),即行政內(nèi)部約談,以期通過(guò)行政實(shí)踐來(lái)佐證行政組織協(xié)調(diào)的發(fā)展變化。綜上所述,本論文研究以行政組織的行政自我規(guī)制為主線,力圖揭示行政自我規(guī)制的組織依賴性,明確行政組織的行政自我規(guī)制的重要意義,進(jìn)而構(gòu)建有效的行政自我規(guī)制之實(shí)現(xiàn)機(jī)制。尤其是在法治政府建設(shè)的當(dāng)下,更需要強(qiáng)調(diào)行政組織的法治建設(shè),以便為實(shí)現(xiàn)行政自我規(guī)制奠定堅(jiān)實(shí)的組織基礎(chǔ)。本文研究主要是基于行政法學(xué)理論基礎(chǔ)之上,同時(shí)重視政治學(xué)、行政學(xué)和管理學(xué)等相關(guān)學(xué)科與行政法學(xué)科之間的互動(dòng),以期為行政自我規(guī)制理論提供一個(gè)相對(duì)充分的論證,最大程度上實(shí)現(xiàn)行政自我規(guī)制之功用。
[Abstract]:How to deal with the administrative power is the eternal topic of human society, also is the core of the administrative law. In the administrative law theory, compared with the external control, administrative self regulation is the controlling mechanism of the controversial. In recent years, due to the rapid expansion of the diversification of administrative tasks and administrative discretion, the external control is some moronic, and administrative regulations are not self developed. Just unfolding in the administrative practice of the rapid development of administrative self regulation, gradually by the administrative law scholars' attention, and carry on systematic research. However, the administrative regulation should be how to realize the self, so far there is lack of comprehensive research results. This situation is not conducive to the development of administrative self regulation theory. Therefore, this paper is mainly from the perspective of administrative organization to analyze, explore the implication in the administrative structure Self regulation and self regulation mechanism of these genes, and how it was empty, and advocated the implementation mechanism through the reconstruction of the administrative organization to construct administrative self regulation. The purpose of this paper is mainly embodied in three aspects: one is the existence of a large number of administrative law in the practice of self revolution government behavior, timely response from the angle of administrative law; two is a multi way to explore the effective control of administrative power, and constantly improve the control mechanism of administrative power; the three is to provide the theoretical support for the construction of the government under the rule of law in our country. The first chapter is the self regulation theory of administrative organization in this paper. Firstly, the basic theory of the administrative regulation of self this mainly includes the concept, the connotation of administrative self regulation. And then discusses the legitimacy basis of administrative self regulation, and the relationship between the government and the rule of law. Then demonstrates the self regulation of gene contains the basic structure of administrative organization in the administrative and self regulation to be nominal. Finally this thesis advocates the implementation mechanism through the reconstruction of the administrative organization to construct administrative self regulation. The second chapter mainly elaborates how to optimize from administrative organization structure to achieve self regulation. This chapter the first interpretation of the administrative organization structure includes horizontal structure, vertical structure and size of the organization in three dimensions, the three directly affects the formation of administrative organization structure. Then, based on the relevant provisions of the administrative organization law, describes the status quo of China's administrative structure, focus on the analysis of the distribution of administrative organization, right of isomorphic responsibility, organization the scale and the modern information technology and the influence on the administrative structure. Finally the paper presented by the chief task oriented administrative organization, right of proper distribution, legal protection, Streamline the effectiveness of specific path, optimizing the structure of administrative organizations to promote the development of administrative self regulation. The third chapter mainly elaborates how from the rational allocation of administrative powers to achieve self regulation. This chapter first defines the configuration of the administrative authority, causes the status quo and problems of the allocation of administrative authority in China and then explain. On this basis, according to the practical situation of China's administrative system reform, a variety of paths to construct a reasonable configuration of the administrative functions, including compliance, decentralization and balance of administrative authority and the relative concentration of specific ways, and provide some useful reference for the rational allocation of administrative power. Finally, discusses on the field of the current administrative practice of a list of power system, because the power list system is the practice of administrative power allocation, has a representative significance. The fourth chapter is mainly on how to promote the Government organization and coordination to achieve self regulation. This chapter first discusses the necessity of administrative organization and coordination, and the relationship with the administrative self regulation. Strengthen interdependence between the administrative organization and administrative tasks, trans regional, cross sectoral nature, is the era background of administrative organization coordination. Then, according to the degree of mandatory administrative organization coordination means, divided into the command and control mode and contract control mode, and expounds the relationship between the two. Contract control as a new coordination mechanism, marking the administrative coordination of modern steering. This paper elaborated the administrative organization and coordination of the emergence of a new trend in practice, namely administrative internal interviews, to to support the development and change of period of administrative coordination through administrative practice. In summary, this study takes the administrative organization of administrative self regulation as the main line, trying to reveal the administrative self regulation The dependence of the significance of the administrative organization of administrative self regulation, self regulation and the construction of administrative implementation mechanisms. Especially in the construction of the government under the rule of law, but also need to emphasize the administrative organization of the construction of the rule of law, in order to lay a solid foundation for the realization of the administrative organization of self regulation. This study is mainly based on the above theory the basis of administrative law, and the importance of political science, administrative science and management science and other related disciplines and the interaction between the subjects of administrative law, in order to administrative self regulation theory to provide a relatively full demonstration, to realize the function of administrative self regulation of the maximum extent.
