【摘要】：隨著經(jīng)濟(jì)的快速發(fā)展和人類文明的不斷進(jìn)步,動(dòng)物福利問(wèn)題和其他道德、環(huán)保問(wèn)題一樣進(jìn)入了人們的關(guān)注視野并逐漸升溫,人們?cè)絹?lái)越注意到動(dòng)物的安全、健康和保障。但在經(jīng)濟(jì)全球化的浪潮中,國(guó)際貿(mào)易自由化和貿(mào)易保護(hù)主義的戰(zhàn)爭(zhēng)從未停歇,一些國(guó)家別有用心地把動(dòng)物福利引入了國(guó)際貿(mào)易的范疇,使其逐漸成為人們利益爭(zhēng)奪的手段,一種新型的貿(mào)易壁壘便應(yīng)運(yùn)而生了。這一趨勢(shì)對(duì)國(guó)際貿(mào)易影響重大,尤其是這種新型的貿(mào)易壁壘被大多數(shù)發(fā)達(dá)國(guó)家利用成為遏制發(fā)展中國(guó)家貿(mào)易出口、制約其經(jīng)濟(jì)發(fā)展的又一手腕,我國(guó)作為最大的發(fā)展中國(guó)家亦深受其害。本文首先從闡釋動(dòng)物福利和動(dòng)物福利壁壘的含義入手,逐漸揭示動(dòng)物福利壁壘的特點(diǎn)、表現(xiàn)形式、產(chǎn)生原因以及造成的影響等,再對(duì)我國(guó)的貿(mào)易現(xiàn)狀進(jìn)行一系列研究分析的基礎(chǔ)上指出我國(guó)所面臨的動(dòng)物福利壁壘問(wèn)題,在綜合分析在WTO框架下與動(dòng)物福利相關(guān)的協(xié)議內(nèi)容以及借鑒一些國(guó)家的相關(guān)舉措,兼顧大勢(shì)潮流和我國(guó)具體國(guó)情以及人類和動(dòng)物雙方利益,最后提出我國(guó)的應(yīng)對(duì)策略,其中主要包括國(guó)際法層面和國(guó)內(nèi)法層面的策略。本文分為四個(gè)組成部分進(jìn)行論述,具體如下:第一部分主要介紹了動(dòng)物福利的內(nèi)涵和發(fā)展過(guò)程,旨在揭示其進(jìn)步意義,進(jìn)而詳細(xì)闡釋動(dòng)物福利壁壘的概念、構(gòu)成要件、特點(diǎn)、產(chǎn)生原因以及形成的影響,深刻的了解亦是為了全面的把握。第二部分主要是在WTO框架下分析動(dòng)物福利壁壘問(wèn)題。該部分較為詳細(xì)的介紹了動(dòng)物福利壁壘在WTO框架下的主要表現(xiàn)形式、動(dòng)物福利壁壘相關(guān)的WTO基本原則、WTO協(xié)議及其在動(dòng)物福利壁壘問(wèn)題中的應(yīng)用并進(jìn)行了一些分析,列舉相關(guān)解決動(dòng)物福利壁壘問(wèn)題的案例作為參考,進(jìn)而指出了在WTO框架下處理動(dòng)物福利壁壘問(wèn)題尚且存在的不足之處以供參考。第三、四部分主要揭示我國(guó)面臨的動(dòng)物福利壁壘問(wèn)題及其原因、策略。本部分針對(duì)我國(guó)面臨的動(dòng)物福利壁壘問(wèn)題從國(guó)際法和國(guó)內(nèi)法兩個(gè)層面闡述了法律方面的策略,國(guó)際法層面的策略主要有:充分利用WTO現(xiàn)行規(guī)則與政策,合理運(yùn)用WTO爭(zhēng)端解決機(jī)制,積極參與WTO有關(guān)動(dòng)物福利規(guī)則的談判,謀求區(qū)域合作等;國(guó)內(nèi)法層面的策略主要有:加快動(dòng)物福利立法,建立健全動(dòng)物福利標(biāo)準(zhǔn),構(gòu)建動(dòng)物福利標(biāo)簽制度、建立動(dòng)物福利壁壘預(yù)警制度和動(dòng)物福利壁壘應(yīng)對(duì)體系。
[Abstract]:With the rapid development of economy and the progress of human civilization, animal welfare and other moral, environmental protection issues have entered the attention of people and gradually heated up, people pay more and more attention to the safety, health and protection of animals. However, in the tide of economic globalization, the war of international trade liberalization and trade protectionism never stops. Some countries have ulterior motives to introduce animal welfare into the scope of international trade, making it gradually become a means for people to compete for interests. A new type of trade barrier came into being. This trend has a significant impact on international trade, especially since this new type of trade barrier has been used by most developed countries as another means of curbing the trade exports of developing countries and restricting their economic development. China, as the largest developing country, has also suffered greatly. This paper begins with the explanation of the meaning of animal welfare and animal welfare barriers, and gradually reveals the characteristics, forms, causes and effects of animal welfare barriers. On the basis of a series of research and analysis on the current situation of China's trade, this paper points out the problem of animal welfare barriers faced by China, and comprehensively analyzes the contents of the agreements related to animal welfare under the framework of WTO, and draws lessons from the relevant measures of some countries. Taking into account the general trend and the specific situation of our country as well as the interests of both human beings and animals, this paper puts forward the countermeasures of our country, which mainly include the international law level and the domestic law level strategy. This paper is divided into four parts: the first part mainly introduces the connotation and development process of animal welfare, aims to reveal its progressive significance, and then explains in detail the concept, elements and characteristics of animal welfare barriers. Causes and formation of the impact, deep understanding is also for a comprehensive grasp. The second part is the analysis of animal welfare barriers under the framework of WTO. This part introduces in detail the main manifestations of animal welfare barriers under the framework of WTO, the basic principles of WTO related to animal welfare barriers, the WTO protocol and its application in animal welfare barriers, and makes some analysis. This paper enumerates relevant cases to solve the problem of animal welfare barriers as a reference, and then points out the shortcomings of dealing with animal welfare barriers under the framework of WTO for reference. Third, the fourth part mainly reveals the animal welfare barrier question which our country faces and the reason, the strategy. This part elaborates the legal strategies from the two aspects of international law and domestic law in view of the problem of animal welfare barriers faced by our country. The strategies in international law mainly include: making full use of the existing rules and policies of WTO. Reasonable use of the WTO dispute settlement mechanism, active participation in the WTO negotiations on animal welfare rules, seeking regional cooperation, and so on. The domestic legal level strategies include: speeding up animal welfare legislation, establishing and perfecting animal welfare standards, and so on. Establish animal welfare label system, animal welfare barrier warning system and animal welfare barrier response system.
