【摘要】：競爭政策一直是自由貿(mào)易協(xié)定中各國密切關(guān)注的問題,許多發(fā)達(dá)國家簽訂的自由貿(mào)易協(xié)定中的競爭政策條款已經(jīng)日趨完善,反觀中國,在自由貿(mào)易協(xié)定競爭政策的簽訂與完善方面一直欠妥,令到我國在國際談判上處于劣勢。本文則通過剖析TPP協(xié)議競爭政策的內(nèi)容及規(guī)制模式,結(jié)合分析中國自貿(mào)協(xié)定競爭政策已有的條約法實(shí)踐,探討TPP協(xié)議競爭政策條款可資借鑒的經(jīng)驗(yàn),為中國將來與其他國家簽訂自貿(mào)協(xié)定競爭政策條款提供參考。第一章首先討論競爭政策與TPP協(xié)議的相關(guān)理論問題,包括競爭政策基本概念與功能、自由貿(mào)易協(xié)定與競爭政策的關(guān)系、TPP協(xié)議的概述。第二章的內(nèi)容是TPP協(xié)議中競爭政策規(guī)則的剖析,主要是對其中的16、17章的具體規(guī)則的分析,還有目標(biāo)與宗旨的討論。第三章的內(nèi)容則是TPP協(xié)議給自由貿(mào)易協(xié)定競爭政策帶來的變化的討論,主要包括競爭政策議題地位的變化、競爭政策規(guī)制模式的變化與競爭政策具體規(guī)則的變化。第四章是TPP協(xié)議對我國FTA競爭政策規(guī)則的啟示,主要介紹我國FTA競爭政策簽署的發(fā)展以及日后競爭政策規(guī)制模式的選擇與競爭政策規(guī)則的民主化、強(qiáng)化對國家企業(yè)的規(guī)制、強(qiáng)化爭端解決機(jī)制四方面應(yīng)該做出的改變。
[Abstract]:Competition policy has always been a matter of close concern to all countries in free trade agreements. The competition policy clauses in free trade agreements signed by many developed countries have become increasingly perfect. In the aspect of signing and perfecting the competition policy of free trade agreement, our country is at a disadvantage in international negotiation. Through analyzing the content and regulation mode of TPP competition policy, combining with the existing treaty law practice of China's FTA competition policy, this paper discusses the experience that TPP competition policy clauses can learn from. It provides a reference for China to sign competition policy clauses with other countries in the future. The first chapter discusses the theoretical issues related to competition policy and TPP agreement, including the basic concept and function of competition policy, the relationship between free trade agreement and competition policy and the outline of TPP agreement. The second chapter is about the analysis of the rules of competition policy in the TPP agreement, including the analysis of the specific rules of Chapter 1617, and the discussion of the objectives and purposes. The third chapter discusses the changes brought by TPP agreement to the competition policy of free trade agreement, including the change of position of competition policy, the change of regulation mode of competition policy and the change of specific rules of competition policy. The fourth chapter is the inspiration of TPP agreement to China's FTA competition policy rules. It mainly introduces the development of China's FTA competition policy signing, the choice of competition policy regulation model and the democratization of competition policy rules in the future, and strengthens the regulation of national enterprises. Four aspects of strengthening the dispute settlement mechanism should be changed.
