我國(guó)政府購(gòu)買公共服務(wù)風(fēng)險(xiǎn)的法律控制研究

【摘要】:政府購(gòu)買公共服務(wù)是一種適應(yīng)社會(huì)發(fā)展需要的新模式和新機(jī)制。在市場(chǎng)經(jīng)濟(jì)和建設(shè)服務(wù)型政府的大背景下,經(jīng)濟(jì)和社會(huì)的加速轉(zhuǎn)型和變革,推動(dòng)了政府職能的轉(zhuǎn)型。政府購(gòu)買公共服務(wù)最先開(kāi)始于西方發(fā)達(dá)國(guó)家,在中國(guó)尚屬于起步階段。政府購(gòu)買公共服務(wù)就是公共服務(wù)運(yùn)作方式適度的市場(chǎng)化。政府的職能應(yīng)該由“生產(chǎn)者”向“管理者”轉(zhuǎn)變,更多的轉(zhuǎn)向規(guī)則的制定、對(duì)象的選擇和服務(wù)質(zhì)量的把控。國(guó)外發(fā)達(dá)國(guó)家在政府購(gòu)買公共服務(wù)領(lǐng)域內(nèi)已經(jīng)具備了較為成熟的經(jīng)驗(yàn)和風(fēng)險(xiǎn)防范機(jī)制,處于起步階段的我國(guó)政府雖然在這一領(lǐng)域取得了初步的發(fā)展,但是同時(shí)也暴露了許多的問(wèn)題。法律法規(guī)的不完善和制度建設(shè)的落后,使政府購(gòu)買公共服務(wù)存在著許多實(shí)際的和潛在的風(fēng)險(xiǎn)。學(xué)術(shù)界分別從經(jīng)濟(jì)學(xué)、管理學(xué)等不同的角度對(duì)風(fēng)險(xiǎn)的控制進(jìn)行了分析研究,本文試圖從風(fēng)險(xiǎn)的法律控制視角對(duì)這一新模式在推行過(guò)程中面臨的問(wèn)題提出有針對(duì)性的建議和控制措施,來(lái)更好的促進(jìn)政府購(gòu)買公共服務(wù)的健康發(fā)展。本文分四部分來(lái)寫。第一部分對(duì)政府購(gòu)買公共服務(wù)風(fēng)險(xiǎn)的含義、類型以及風(fēng)險(xiǎn)生成的原因進(jìn)行了深入的闡述,指出了政府在簽訂購(gòu)買合同前及履行合同中所面臨的風(fēng)險(xiǎn);第二部分對(duì)政府購(gòu)買公共服務(wù)風(fēng)險(xiǎn)法律控制的必要性進(jìn)行了剖析,首先,對(duì)美國(guó)、英國(guó)、日本購(gòu)買公共服務(wù)風(fēng)險(xiǎn)控制取得的成功和對(duì)我國(guó)的啟示進(jìn)行了闡述,進(jìn)而分析了風(fēng)險(xiǎn)法律控制措施對(duì)秩序和安全的保障作用,對(duì)維護(hù)國(guó)家和社會(huì)公共利益、促進(jìn)政府購(gòu)買公共服務(wù)的健康發(fā)展的重大意義;第三部分指出了我國(guó)當(dāng)前在立法層面和配套機(jī)制建設(shè)上的不足,立法的不完善和配套制度的不健全使政府購(gòu)買公共服務(wù)的風(fēng)險(xiǎn)不能得到有效的控制;最后在綜合考量立法、政策及當(dāng)前現(xiàn)狀的情況下,立足長(zhǎng)遠(yuǎn),提出了針對(duì)這一新模式的風(fēng)險(xiǎn)法律控制措施,即:在構(gòu)建完備的政府購(gòu)買公共服務(wù)法律體系的基礎(chǔ)上,完善公開(kāi)透明的政府購(gòu)買公共服務(wù)信息公開(kāi)制度,健全政府購(gòu)買公共服務(wù)的監(jiān)督制度,科學(xué)建構(gòu)政府購(gòu)買公共服務(wù)評(píng)估機(jī)制,拓補(bǔ)政府購(gòu)買公共服務(wù)糾紛處理機(jī)制。以期能夠使這一新模式在我國(guó)走上一條法治化、專業(yè)化和規(guī)范化的道路,使得政府購(gòu)買公共服務(wù)這一新模式在我國(guó)取得長(zhǎng)足的發(fā)展。
[Abstract]:Government purchase of public service is a new model and new mechanism to meet the needs of social development. Under the background of market economy and construction of service-oriented government, the accelerated transformation and transformation of economy and society has promoted the transformation of government functions. The government purchase of public service first began in western developed countries, and in China it is still in its infancy. The government's purchase of public service is a moderately market-oriented way of the operation of public service. The function of the government should be changed from "producer" to "manager", more to the formulation of the rules, the choice of the object and the control of the quality of service. The developed countries have already had more mature experience in the field of government purchase of public service. The government has made preliminary development in this field, but it has also exposed many problems at the same time. The imperfect laws and regulations and the backwardness of the system construction make the government have many practical and latent risks for the government to buy public services. The academic circles are from economics and management respectively. This paper tries to make an analysis and Research on risk control at different angles. This paper tries to put forward pertinent suggestions and control measures from the perspective of legal control of risk in order to better promote the healthy development of the government's purchase of public service. This article is divided into four parts. The first part is on the government. The meaning, types and causes of the risk of buying public services are deeply expounded, the risks faced by the government before signing the purchase contract and the implementation of the contract are pointed out. The second part analyses the necessity of the legal control of the government's risk of purchasing public services. First, the purchase of public clothes in the United States, the United Kingdom, and Japan. The success of the business risk control and the enlightenment to our country are expounded, and then the important significance of the protection of the risk legal control measures to order and security, to safeguard the public interests of the state and the society, and to promote the healthy development of the government to purchase public services; third points are pointed out at the legislative level and supporting machine at present in China. The deficiencies in the system construction, the imperfect legislation and the unsound supporting system make the government's risk of buying public service can not be effectively controlled. Finally, based on the comprehensive examination of legislation, policy and the current situation, the risk legal control measures for this new model are put forward in the long run, that is, to build a complete government purchase. On the basis of the legal system of public service, we should perfect the open and transparent government to buy public service information disclosure system, improve the supervision system of the government to purchase public service, construct the government purchase public service evaluation mechanism scientifically, and make up the government to purchase public service dispute processing mechanism. The new mode of governance, specialization and normalization has made great progress in the government's purchase of public services.
