工程建設(shè)招標投標違法違規(guī)行為治理研究

【摘要】:1978年之后,我國作出了將國家建設(shè)的工作重心轉(zhuǎn)移到經(jīng)濟建設(shè)上來的重大戰(zhàn)略決策。自此,我國建筑市場的管理和經(jīng)營掀開了嶄新的篇章,越來越多的工程項目、貨物、服務(wù)都采用招標投標的形式選擇中意的合作伙伴。隨著項目的日積月累,流動于工程建設(shè)方面的資金總量與日俱增,直接促進了建筑行業(yè)蒸蒸日上的發(fā)展?墒,經(jīng)濟快速高效地發(fā)展并不能掩蓋其中存在的問題,F(xiàn)今,招標投標市場充斥著眾多違法違規(guī)行為,嚴重影響了我國建筑市場的正常運轉(zhuǎn),因此當(dāng)務(wù)之急是找出這些違法違規(guī)行為的原因,并提出切實可行的治理對策。首先,本文通過對招標投標相關(guān)理論的總結(jié)分析,引出了關(guān)于招標投標違法違規(guī)的對稱性問題——招標投標規(guī)范性的內(nèi)涵解構(gòu)問題。研究了招標投標規(guī)范性概念的內(nèi)涵和屬性特點,在此基礎(chǔ)上,結(jié)合招標投標各方參與人的實際違法違規(guī)常見行為,初步分類分析了各方違法違規(guī)行為的外部表象及其危害性。其次,根據(jù)相關(guān)理論,結(jié)合工程建設(shè)招標投標的實踐表現(xiàn),從經(jīng)濟利益、違法違規(guī)成本、法律法規(guī)、市場監(jiān)管,惡性競爭,產(chǎn)業(yè)結(jié)構(gòu)及投資結(jié)構(gòu),信息不對稱和市場信用等8個方面對前文分析的危害性問題的表象性成因在理論層面進行了更深入地分析,并進一步梳理和揭示出工程建設(shè)招標投標違法違規(guī)行為形成的路徑和演進邏輯。再次,在歸納招標投標違法違規(guī)行為影響因素的基礎(chǔ)上,構(gòu)建了一種新的分析方法,以更科學(xué)地對前述各影響因素進行細化和定量研究。采用層次分析法計算權(quán)重值,確定影響因素對招標投標違法違規(guī)的影響權(quán)重,為下一步模糊理論的應(yīng)用提供前導(dǎo)基礎(chǔ);采用模糊理論量化評判經(jīng)濟類、信用類以及法規(guī)制度類三大類的14個影響因素對招標投標違法違規(guī)的隸屬度,評估此三大類因素對招標投標違法違規(guī)行為的影響程度;結(jié)合調(diào)研,采用卡方檢驗的方法,實證分析14個因素與招標投標違法違規(guī)的關(guān)聯(lián)性,為進一步制定具體的相關(guān)治理對策提供理論依據(jù)。最后,針對以上研究中得出的影響招標投標違法違規(guī)的關(guān)鍵性因素,開展了相應(yīng)治理對策研究,并構(gòu)建出法律制度型、利益杠桿型和信用治理型三個類型的治理對策。其中,法律制度型對策從統(tǒng)一有關(guān)法律法規(guī)、規(guī)范行政監(jiān)管人員的法律責(zé)任、改進資格審查制度、完善《反不正當(dāng)競爭法》、改革招標投標最低價中標和建立招標人終身負責(zé)制度等六個方面進行闡述;利益杠桿型對策給出了激勵型和懲戒型等兩方面的對策;信用治理型對策主要從健全招標投標的信用法律法規(guī)體系及監(jiān)管體系、完善招標投標各方的信用水平信息披露體系以及從源頭管控好投標人的資質(zhì)信用管理三個方面展開。
[Abstract]:After 1978, China has made a major strategic decision to transfer the focus of national construction to economic construction. Since then, the management and management of the construction market in our country have opened a new chapter. More and more projects, goods and services are chosen by the form of tender and tendering. However, the rapid and efficient development of the economy can not cover up the problems. Nowadays, the bidding market is full of many illegal and illegal activities, which seriously affect the normal operation of the construction market in China, so it is a matter of business. The urgent is to find out the reasons for these illegal activities and put forward practical countermeasures. First, through the summary and analysis of the related theories of bidding and bidding, this paper leads to the problem of symmetry about the violation of illegal bidding and bidding, the connotation deconstruction of the standard of tendering and bidding, and the connotation of the concept of the standard of bidding and tender. On this basis, on this basis, combined with the common behavior of the participants in the bidding and bidding, the external appearance and harmfulness of the illegal and illegal activities of all parties are preliminarily classified and analyzed. Secondly, according to the relevant theories and the practice of bidding and bidding of engineering construction, the economic benefits, illegal costs, laws and regulations, and the city's laws and regulations are presented. In 8 aspects, such as field supervision, vicious competition, industrial structure and investment structure, information asymmetry and market credit, this paper makes a more in-depth analysis on the imaginary causes of the harmfulness of the previous analysis, and further combs and reveals the path and evolution logic of the formation of the violation of law and violation behavior in the construction bidding and bidding. On the basis of inducing the factors affecting the illegal and irregularities of tendering and bidding, a new analysis method is constructed to make a more scientific study of the foregoing and quantitative factors. The weight values are calculated by the analytic hierarchy process (AHP) to determine the influence weight of the influencing factors on the illegal and illegal bidding and bidding, and the application of the next fuzzy theory is proposed. For the preamble foundation, we use the fuzzy theory to quantify the degree of membership of the 14 factors of the three major categories of economic, credit and regulations, and evaluate the degree of the influence of the three major factors on the illegal and irregularities of tendering and bidding, and combine the investigation and use the method of Chi square test to analyze 14 factors and recruitment. In order to provide the theoretical basis for further formulating the relevant countermeasures, the relevant countermeasures are carried out, and the three types of legal system, benefit leverage type and credit governance type are constructed. In the six aspects of the legal system, the legal system countermeasures include the unification of relevant laws and regulations, the legal responsibility of the administrative regulators, the improvement of the qualification examination system, the improvement of the anti unfair competition law, the reform of the lowest bid in bidding and the establishment of the tenderer's life-long responsibility system, and the incentive type of the interest leveraged countermeasures. Two countermeasures, such as the punishment type, and so on; the credit governance countermeasures are mainly from perfecting the credit law and regulation system and the supervision system, perfecting the information disclosure system of the tendering and bidding parties and the three aspects of the qualified bidders' creditworthiness management from the source.
