【摘要】：目前,人類對南極的探索逐步深入,特別是加大了對南大洋生物資源的開發(fā)利用,比如對南極磷蝦和犬牙魚的商業(yè)捕撈。但是,由于過度捕撈甚至IUU捕撈,南極海域生物多樣性面臨威脅。面對這一挑戰(zhàn),南極海洋生物資源養(yǎng)護(hù)委員會根據(jù)《南極海洋生物資源養(yǎng)護(hù)公約》等公約,通過了一系列養(yǎng)護(hù)措施,建立了南極海洋保護(hù)區(qū)。這是南極海洋生物資源保護(hù)的新發(fā)展。南極海洋保護(hù)區(qū)是公海保護(hù)區(qū)網(wǎng)絡(luò)建設(shè)的重要部分,并涉及南極國際治理和中國的南極利益,目前國內(nèi)對此關(guān)注不多,具有一定研究價(jià)值。本文首先介紹了海洋保護(hù)區(qū)的定義和功能,全球其他地區(qū)的海洋保護(hù)區(qū)實(shí)踐對南極海域的借鑒意義;然后,針對南極海洋保護(hù)區(qū)的實(shí)質(zhì)即南極海洋生物資源保護(hù),從全球視野和區(qū)域角度分別進(jìn)行國際法分析;再結(jié)合法律與實(shí)踐,重點(diǎn)闡述了南極已建立的兩個(gè)海洋保護(hù)區(qū)以及總體框架規(guī)定;隨后,在國際和南極的背景下,對南極海洋保護(hù)區(qū)的前景予以展望。由于國際社會的環(huán)境意識、合作意識的增強(qiáng),加上科學(xué)技術(shù)水平的提高,南大洋將會有更多的海洋保護(hù)區(qū)得到建立。中國是CCAMLR的重要一員,在南極海洋保護(hù)區(qū)發(fā)展中應(yīng)當(dāng)發(fā)揮更加積極的建設(shè)性作用,將全球環(huán)境利益和自身國家利益有機(jī)結(jié)合起來。
[Abstract]:At present, the exploration of Antarctica has gradually deepened, especially the exploitation and utilization of biological resources in the Southern Ocean, such as commercial fishing of Antarctic krill and canine toothfish.However, because of overfishing and even IUU fishing, biodiversity in Antarctic area is threatened.In the face of this challenge, CCAMLR has adopted a series of conservation measures in accordance with the Convention for the Conservation of Antarctic Marine living Resources (CCAMLR) and has established the Antarctic Marine protected area (CCAMLR).This is a new development in the conservation of Antarctic marine living resources.The Antarctic marine protected area is an important part of the network construction of the high seas protected area, and involves the Antarctic international governance and the Antarctic interest of China. At present, there is not much attention to this in our country, which has certain research value.This paper first introduces the definition and function of marine protected areas, and the practice of marine protected areas in other parts of the world for reference to the Antarctic sea area, and then, in view of the essence of the Antarctic marine protected area, that is, the conservation of Antarctic marine living resources,An analysis of international law from a global perspective and a regional perspective, followed by a combination of law and practice, focusing on the two marine protected areas established in Antarctica and the overall framework provisions; and subsequently, in the international and Antarctic context,The prospect of Antarctic marine protected area is prospected.More marine protected areas will be established in the Southern Ocean as a result of the environmental awareness of the international community, the enhancement of the sense of cooperation, and the improvement of science and technology.As an important member of CCAMLR, China should play a more active and constructive role in the development of Antarctic Marine protected areas and combine the global environmental interests with its own national interests.
