【摘要】：當(dāng)前,“停車難”的問(wèn)題在我國(guó)許多城市中愈演愈烈,伴隨著天價(jià)停車收費(fèi)備受質(zhì)疑、外包經(jīng)營(yíng)的停車管理公司缺乏有效外部監(jiān)管以及公共道路停車位施劃責(zé)任不明等停車亂象時(shí)有發(fā)生,如何優(yōu)化治理城市公共道路停車位正考驗(yàn)著行政機(jī)關(guān)的社會(huì)服務(wù)效能。事實(shí)上,要想充分解決城市公共道路停車?yán)Ь?離不開(kāi)對(duì)公共道路停車位的公物屬性進(jìn)行分析研究。本文在行政法公物理論指導(dǎo)下,從公物的所有權(quán)、公物的支配權(quán)和公物的利用權(quán)等角度觀察并分析城市公共道路停車位在管理上的缺失,指出管理混亂是導(dǎo)致城市公共道路停車難題產(chǎn)生的根本原因,并提出城市公共道路停車位管理和利用的優(yōu)化措施,為我國(guó)公物理論制度化、體系化發(fā)展提供經(jīng)驗(yàn)素材,也為推進(jìn)政府改善城市交通、建立以公共福祉為主要發(fā)展方向的服務(wù)型政府具有重要意義。
[Abstract]:At present, the problem of "parking difficulty" is becoming more and more serious in many cities of our country. Parking chaos, such as the lack of effective external supervision by outsourced parking management companies and the lack of clear responsibility for parking spaces on public roads, occurs from time to time. How to optimize the management of parking spaces on urban public roads is testing the social service effectiveness of administrative organs. In fact, if we want to fully solve the parking dilemma of urban public roads, This article, under the guidance of administrative law public property theory, from the ownership of public property, From the view of controlling right of public property and utilizing right of public property, this paper analyzes the lack of management of parking space on urban public road, and points out that the confusion of management is the fundamental cause of the difficult problem of parking on urban public road. The paper also puts forward the optimization measures for the management and utilization of the parking spaces on urban public roads, which will provide experience materials for the systematization and systematic development of the public property theory in China, as well as promote the government to improve the urban traffic. It is of great significance to establish a service-oriented government with public welfare as the main development direction.
