【摘要】：傳統(tǒng)巡游式出租車(chē)行業(yè)肩負(fù)著城市公共交通的重?fù)?dān),由于受到政府的數(shù)量管控,處于一種供不應(yīng)求的狀態(tài),網(wǎng)約車(chē)的出現(xiàn),在一定程度上緩解了這種供小于求的局面,就如同學(xué)者所認(rèn)為的網(wǎng)絡(luò)約車(chē)不僅實(shí)現(xiàn)了出行的高效和便捷,還發(fā)掘了群眾未被滿(mǎn)足的需求并緩解了公共出行供給不足的"痛點(diǎn)"。但是,由于網(wǎng)約車(chē)的迅猛發(fā)展,其自身的不足也不斷凸顯,對(duì)傳統(tǒng)巡游式出租車(chē)行業(yè)的不利影響也隨著矛盾的加深而加深,沖突也隨之加劇。2015年,在我國(guó)多地爆發(fā)了巡游式出租車(chē)司機(jī)罷工抵制網(wǎng)約車(chē)的事件,巡游式出租車(chē)罷工,對(duì)一個(gè)城市造成的損失是巨大的。道路交通的癱瘓、群眾出行的不便,這些都讓人對(duì)網(wǎng)約車(chē)這一新業(yè)態(tài)進(jìn)行思考,并提出了對(duì)網(wǎng)約車(chē)規(guī)制的法律制度,但是,從目前的規(guī)制制度上看,仍存在一些問(wèn)題,例如在規(guī)制的主體、市場(chǎng)準(zhǔn)入條件、運(yùn)營(yíng)監(jiān)管、主體責(zé)任等方面。網(wǎng)約車(chē)作為一種伴隨互聯(lián)網(wǎng)技術(shù)發(fā)展而發(fā)展起來(lái)的新事物,我國(guó)規(guī)制網(wǎng)約車(chē)行為的法律法規(guī)還不是很完善,尚存在很多問(wèn)題,但是從網(wǎng)約車(chē)和傳統(tǒng)巡游式出租車(chē)行業(yè)的矛盾來(lái)看,現(xiàn)有的法律規(guī)制制度并不能很好的緩解或解決兩者的矛盾,所以構(gòu)建完善的監(jiān)管法律制度是十分必要的,也是切實(shí)可行的。所以本文旨在通過(guò)討論監(jiān)管的實(shí)施主體、網(wǎng)約車(chē)的市場(chǎng)準(zhǔn)入、運(yùn)營(yíng)監(jiān)管以及主體責(zé)任等問(wèn)題,提出如何構(gòu)建完善網(wǎng)約車(chē)行為的監(jiān)管法律制度體系,使監(jiān)管部門(mén)能夠更有效率地進(jìn)行監(jiān)管。
[Abstract]:The traditional tour taxi industry is shouldering the heavy burden of urban public transport. Because of the government's quantity control, it is in a state of short supply, and the appearance of the net ride-sharing alleviates to a certain extent the situation that the supply is less than the demand. As the scholars believe, the online car ride not only realizes the high efficiency and convenience of the trip, but also uncovers the unmet demand of the masses and alleviates the "pain point" of the insufficient supply of public travel. However, due to the rapid development of the online car, Its own shortcomings are also constantly highlighted, and the adverse impact on the traditional tour taxi industry has deepened with the deepening of the contradictions, and the conflict has also intensified. In 2015, there was an incident in our country in which the tour taxi drivers went on strike to boycott the ride-sharing network. The travelling taxi strike has caused a huge loss to a city. The paralysis of road traffic and the inconvenience caused by mass travel all make people think about the new form of car sharing on the net, and put forward a legal system for regulating the net car chartering. However, from the point of view of the current regulation system, there are still some problems, such as the subject of regulation, market access conditions, operation supervision, subject responsibility and so on. The laws and regulations to regulate the behavior of ride-hailing in our country are not perfect and there are still many problems. However, from the perspective of the contradiction between net-ride-hailing and traditional cruising taxi industry, The existing legal regulation system can not alleviate or solve the contradiction between the two, so it is very necessary and feasible to construct a perfect regulatory legal system. On the basis of the problems of market access, operation supervision and main body responsibility, the author puts forward how to construct and perfect the legal system of the regulation of ride-sharing behavior, so as to make the supervision department more efficient.
