【摘要】：習(xí)近平總書記在慶祝全國(guó)人民代表大會(huì)成立六十周年大會(huì)上發(fā)表重要講話,習(xí)總書記指出:“人民代表大會(huì)制度是中國(guó)特色社會(huì)主義制度的重要組成部分,也是支撐中國(guó)國(guó)家治理體系和治理能力的根本政治制度。新形勢(shì)下,我們要毫不動(dòng)搖堅(jiān)持人民代表大會(huì)制度,也要與時(shí)俱進(jìn)完善人民代表大會(huì)制度�！绷�(xí)總書記強(qiáng)調(diào)了人民代表大會(huì)制度對(duì)于我國(guó)社會(huì)主義民主政治的重要作用,而且進(jìn)一步強(qiáng)調(diào)要推動(dòng)人民代表大會(huì)制度與時(shí)俱進(jìn)。8代議制的真正優(yōu)勢(shì)就在于按規(guī)則開會(huì)和議事,從而使會(huì)議結(jié)論具有充分的正當(dāng)性,這就是人們常說的有程序正義而導(dǎo)致結(jié)果正義�？v觀我國(guó)的人民代表大會(huì)議事規(guī)則,自1989年《全國(guó)人民代表大會(huì)議事規(guī)則》制定之后并未進(jìn)行過修改,但我國(guó)各地方的人民代表大會(huì)議事規(guī)則卻在社會(huì)主義現(xiàn)代化建設(shè)的過程中不斷結(jié)合當(dāng)前社會(huì)實(shí)際、當(dāng)?shù)貙?shí)情和人大實(shí)踐經(jīng)驗(yàn)經(jīng)進(jìn)行了相關(guān)的修改和修訂。就在2017年年初,寧夏回族自治區(qū)第十一屆人民代表大會(huì)第七次會(huì)議還對(duì)《寧夏回族自治區(qū)人民代表大會(huì)議事規(guī)則》進(jìn)行了第二次修訂。這些修訂之中必然蘊(yùn)含了一些積極、有益的有效嘗試,也展示了我國(guó)人大議事規(guī)則發(fā)展趨勢(shì)以及一些值得我們借鑒和推廣的方面。但針對(duì)我國(guó)省級(jí)地方人大議事規(guī)則的比較研究在學(xué)界甚少見到,而本文的研究重點(diǎn)就是將全國(guó)人大議事規(guī)則以及我國(guó)省級(jí)地方人大議事規(guī)則進(jìn)行系統(tǒng)的比較研究,使得人大議事規(guī)則的研究更為全面。而且,用我國(guó)各地方人大議事規(guī)則的修訂和發(fā)展經(jīng)驗(yàn),來為我國(guó)議事規(guī)則的整體發(fā)展提供啟發(fā)啟示,用在我國(guó)人大議事規(guī)則修改實(shí)踐中總結(jié)出來的經(jīng)驗(yàn)教訓(xùn)和理論成果,來指導(dǎo)我國(guó)人大議事規(guī)則的進(jìn)一步發(fā)展。這在某種程度上也是堅(jiān)持中國(guó)特色社會(huì)主義的理論自信、制度自信和文化自信。本文將全國(guó)人民代表大會(huì)議事規(guī)則以及各省級(jí)地方人民代表大會(huì)議事規(guī)則進(jìn)行研究和分析,從我國(guó)人大議事規(guī)則修改修訂的演化和各地方人民代表大會(huì)議事規(guī)則的相互比較這兩個(gè)維度進(jìn)行探討分析,發(fā)現(xiàn)和梳理我國(guó)人大議事規(guī)則在修改制定方面的有益實(shí)踐和相關(guān)趨勢(shì),由此希望能給我國(guó)人大議事規(guī)則的完善以有益的啟發(fā)。
[Abstract]:General Secretary Xi Jinping delivered an important speech in celebration of the 60 anniversary of the founding of the National people's Congress. General Secretary Xi said: "the people's Congress system is an important part of the socialist system with Chinese characteristics. It is also the fundamental political system that supports China's state governance system and its ability to govern. Under the new situation, we must unswervingly adhere to the people's Congress system. It is also necessary to keep pace with the times and improve the people's Congress system. "General Secretary Xi stressed the important role of the people's Congress system in socialist democratic politics in China," he said. And further emphasizing that the real advantage of advancing the system of people's congresses with the times lies in meeting and deliberating in accordance with the rules, thus giving full legitimacy to the conclusions of the Conference, This is what is often said to be procedural justice leading to justice of results. Looking at the rules of procedure of the National people's Congress, the rules of procedure of the National people's Congress have not been amended since 1989, when the rules of procedure of the National people's Congress were enacted. However, in the process of socialist modernization, the rules of procedure of the people's congresses in various localities in China have been continuously combined with the current social realities. The local facts and the practical experience of the people's congresses have been revised and amended. In early 2017, The 7th session of the 11th people's Congress of the Ningxia Hui Autonomous region also revised the rules of procedure of the people's Congress of the Ningxia Hui Autonomous region for the second time. It also shows the developing trend of the rules of procedure of the people's Congress of our country and some aspects that we should learn from and promote. However, the comparative research on the rules of procedure of the local people's congresses at the provincial level in our country is seldom seen in academic circles. The focus of this paper is to make a systematic comparative study of the rules of procedure of the National people's Congress and the rules of procedure of local people's congresses at the provincial level in order to make the study of the rules of procedure of the people's congresses more comprehensive. Using the revision and development experience of the rules of procedure of the local people's congresses in our country, to provide inspiration for the overall development of the rules of procedure of our country, and to apply the lessons and theoretical achievements summed up in the practice of the revision of the rules of procedure of the people's congresses of our country. To guide the further development of the rules of procedure of the people's Congress of China. To some extent, this is also the theoretical self-confidence of adhering to socialism with Chinese characteristics. This paper studies and analyzes the rules of procedure of the National people's Congress and the rules of procedure of the provincial and local people's congresses. From the perspective of the evolution of the revision of the rules of procedure of the people's congresses and the comparison of the rules of procedure of the local people's congresses, This paper finds out and combs the beneficial practice and relevant trend of the revision and formulation of the rules of procedure of the National people's Congress of our country, and hopes to give beneficial inspiration to the perfection of the rules of procedure of the people's Congress of our country.
