【摘要】：伴隨移動(dòng)互聯(lián)網(wǎng)的普及,網(wǎng)約車已成為中國(guó)發(fā)展共享經(jīng)濟(jì)的最佳切入點(diǎn),網(wǎng)約車自我國(guó)問世以來(lái),經(jīng)歷了被“否定-中立-合法化”的轉(zhuǎn)變歷程�！豆芾磙k法》的出臺(tái),使我國(guó)成為首個(gè)在國(guó)家層面承認(rèn)網(wǎng)約車合法化的國(guó)家,其對(duì)網(wǎng)約車這一業(yè)態(tài)的市場(chǎng)準(zhǔn)入、經(jīng)營(yíng)行為、法律責(zé)任、監(jiān)督檢查等事項(xiàng)做出了指導(dǎo)性規(guī)定。但是網(wǎng)約車合法化只是起步,簡(jiǎn)單套用傳統(tǒng)的出租車管理模式,已不適合網(wǎng)約車服務(wù)這一新業(yè)態(tài)的發(fā)展。各地新政陸續(xù)公布后,社會(huì)各界也爭(zhēng)議不斷,主要集中在市場(chǎng)準(zhǔn)入的行政審批制、法律責(zé)任的認(rèn)定、網(wǎng)約車保險(xiǎn)制度等方面。本文將對(duì)網(wǎng)約車監(jiān)管存在的若干問題進(jìn)行分析探討并提出完善建議,以期推動(dòng)網(wǎng)約車行業(yè)健康、有序發(fā)展。本文主要分為四個(gè)部分:首先,對(duì)網(wǎng)約車的基本理論做簡(jiǎn)要概述,介紹網(wǎng)約車的起源及發(fā)展概況,總結(jié)其快速發(fā)展的原因、分析不同運(yùn)營(yíng)模式下涉及的法律關(guān)系;其次,指出網(wǎng)約車監(jiān)管的必要性,概括網(wǎng)約車監(jiān)管的發(fā)展歷程及國(guó)內(nèi)網(wǎng)約車監(jiān)管現(xiàn)狀;再次,概括我國(guó)網(wǎng)約車監(jiān)管中存在的問題:如行政主體過(guò)度干預(yù)市場(chǎng)、法律責(zé)任認(rèn)定不明、網(wǎng)約車保險(xiǎn)制度不完善,并分析其原因;最后,在前部分對(duì)網(wǎng)約車分析論證的基礎(chǔ)上,提出應(yīng)采取“政府管平臺(tái)、平臺(tái)管車人”的監(jiān)管模式,明確各方主體法律責(zé)任,完善網(wǎng)約車保險(xiǎn)制度,推動(dòng)網(wǎng)約車依法合規(guī)運(yùn)營(yíng)。
[Abstract]:With the popularity of the mobile Internet, car-sharing has become the best entry point for the development of shared economy in China. Since the advent of China, it has gone through the process of "negative-neutral legalization". China has become the first country to recognize the legalization of ride-sharing at the national level. Supervision and inspection and other matters have made guiding provisions. But the legalization of online ride-sharing is only a start. Simply applying the traditional taxi management mode is no longer suitable for the development of the new business of ride-sharing services. After the new policies have been announced one after another, There are also many disputes in the society, which mainly focus on the administrative examination and approval system of market access, the determination of legal liability, the insurance system of net car chartering, etc. This paper will analyze and discuss some problems existing in the supervision of net car charter and put forward some suggestions to improve it. This paper is mainly divided into four parts: firstly, the basic theory of net-ride-hailing is briefly summarized, the origin and development of net-ride-hailing are introduced, and the reasons for its rapid development are summarized. Analyze the legal relationship involved in different operation modes; secondly, point out the necessity of the regulation, summarize the development process of the regulation and the current situation of domestic regulation; third, This paper summarizes the problems existing in the regulation of net car in our country, such as excessive intervention of the administrative body in the market, the identification of the legal liability is unclear, the insurance system of the net car is not perfect, and the reasons are analyzed. Finally, on the basis of the analysis and argumentation of the first part of the article, It is suggested that the supervision mode of "government management platform, platform management person" should be adopted, the main legal responsibility of all parties should be clearly defined, the insurance system of net car charter should be perfected, and the compliance operation of network car charter should be promoted according to law.
