全面依法治國視域下中學生法制意識培育研究

【摘要】:黨的十八屆四中全會討論并通過了《關于全面推進依法治國若干重大問題的決定》,這個決定可以說是自中共成立以來第一次以執(zhí)政黨最高政治文件的形式,對在新的歷史時期帶領全國各族人民全面推進依法治國、加快法制中國建設,做出的具有劃時代意義的重大戰(zhàn)略決策。本《決定》的通過與實施,標志著我黨作為新時期,新形勢下的執(zhí)政黨的執(zhí)政理念和執(zhí)政方式發(fā)生了巨大轉變,發(fā)展到了依法治國和依法治黨的歷史新高度。本《決定》的通過與實施同時也意味著我國的“五位一體”建設和全面深化改革進入了法制化的新階段。市場經濟條件下,法治興則國家興,法治強則國家強。(1)當前,我國正處于全面深化改革開局起步的歷史新方位,面臨經濟社會雙重轉型的挑戰(zhàn),問題復雜矛盾交織,治理難度前所未有。無論是破解難題、化解矛盾、凝聚共識,還是激發(fā)動力、促進和諧、推動發(fā)展,唯有更加自覺運用法制這個集中體現(xiàn)現(xiàn)代化治理本質要求的思維和方式,在法制軌道上尋求制度化解決之道,我們才能啃下改革攻堅期的一個個硬骨頭,涉過利益格局調整的深水區(qū),使各項制度更加成熟、更加定型,促使社會公平正義,維護社會和諧穩(wěn)定,保障人民安居樂業(yè),推進全面深化改革,實現(xiàn)國家長治久安。推動國家法制進程的歷史責任必將毫無疑問的落在未來社會主義建設者和接班人的中學生身上。因此,如何增強中學生的法律意識,改善中學生的法制觀念,逐步提高他們的法治素質必將成為中學生法制培育的重要課題。本文筆者以濮陽縣為例,試圖探索在全面依法治國視域下中學生法制意識培育存在的問題及相應對策。本文運用文獻研究法,在深入研讀和剖析國內外關于中學生法制意識培育著作的前提下,認真梳理全面依法治國與中學生法制意識培育的密切關系,進一步理清與中學生法制意識培育有關的一些概念。秉承學術研究的科學性,采用訪談交流法和問卷調查法對濮陽縣中學生法制意識現(xiàn)狀進行調查和分析。進而從政治經濟體制的影響、社會環(huán)境的負面影響、教育環(huán)境的負面影響予以歸因。在深入研究和全面把握國內外法制意識培育積極經驗和缺陷不足的基礎上,筆者結合濮陽縣法制教育的現(xiàn)狀提出強化中學生法制意識培育的幾點對策建議。對策建議主要有以下三個方面:第一,政府層面:完善培育體系;第二,社會層面:凈化社會環(huán)境;第三,教育層面:優(yōu)化教育環(huán)境。筆者希望能通過本文為提升濮陽縣及全國中學生的法制意識整體水平提供一些建議和指導。
[Abstract]:The fourth Plenary session of the 18 CPC Central Committee discussed and adopted the "decision on comprehensively promoting the Rule of Law on several important issues", which can be said to be the first time since the founding of the Communist Party of China that it has taken the form of the ruling party's highest political document. In the new historical period, the adoption and implementation of this decision marks a new era for the adoption and implementation of this important strategic decision to lead the people of all ethnic groups throughout the country to comprehensively advance the rule of law and speed up the construction of China under the rule of law. Under the new situation, the ruling party's ruling concept and ruling mode have undergone tremendous changes. The adoption and implementation of this decision also means that China's "five-in-one" construction and comprehensive deepening of reform have entered a new stage of legalization. At present, our country is in the new historical position of the beginning of comprehensive deepening reform, facing the challenge of double economic and social transformation, and the complicated contradictions intertwined. The difficulty of governance is unprecedented. Whether it is to solve difficult problems, to resolve contradictions, to gather consensus, or to stimulate power, promote harmony, and promote development, only more conscious use of the legal system, which embodies the essence of modern governance, is the only way of thinking and means. Only when we seek institutional solutions on the track of the rule of law can we nibble the hard bones of the period of reform and attack the difficult period, get involved in deep-water areas where the pattern of interests has been adjusted, make various systems more mature and formalize, and promote social equity and justice. To maintain social harmony and stability, to ensure that the people live and work in peace and contentment, and to promote comprehensive and deepening reform, The historical responsibility for promoting the process of national legal system will undoubtedly fall on the middle school students of the future socialist builders and successors. Therefore, how to enhance the legal consciousness of the middle school students, Improving the concept of legal system of middle school students and gradually improving their quality of ruling by law will become an important subject for the cultivation of the legal system of middle school students. This paper takes Puyang County as an example. This paper tries to explore the problems and corresponding countermeasures of cultivating the legal consciousness of middle school students from the perspective of ruling the country according to the law in an all-round way. This paper uses the literature research method to deeply study and analyze the domestic and foreign works on the cultivation of the legal consciousness of middle school students. Carefully combing the close relationship between the overall rule of law and the cultivation of middle school students' legal consciousness, further clarifying some concepts related to the cultivation of middle school students' legal consciousness, and adhering to the scientific nature of academic research. The present situation of legal consciousness of middle school students in Puyang County is investigated and analyzed by means of interviews and questionnaires. Then, the influence of political and economic system and the negative impact of social environment are analyzed. The negative effects of the educational environment are attributed. On the basis of in-depth study and comprehensive grasp of the positive experience and defects in the cultivation of legal consciousness at home and abroad, Combined with the present situation of legal education in Puyang County, the author puts forward some countermeasures and suggestions to strengthen the cultivation of legal consciousness of middle school students. The countermeasures and suggestions are as follows: first, government level: perfect cultivation system; second, Social level: purify social environment; third, education level: optimize educational environment. The author hopes to provide some suggestions and guidance for improving the overall level of legal consciousness of middle school students in Puyang County and the whole country through this article.
