【摘要】：當(dāng)前,我國(guó)經(jīng)濟(jì)發(fā)展正處于新常態(tài)階段,實(shí)施創(chuàng)新驅(qū)動(dòng)發(fā)展戰(zhàn)略,推進(jìn)產(chǎn)業(yè)結(jié)構(gòu)轉(zhuǎn)型升級(jí),成為我國(guó)經(jīng)濟(jì)發(fā)展的必然選擇。版權(quán)產(chǎn)業(yè)作為知識(shí)產(chǎn)權(quán)經(jīng)濟(jì)的重要組成部分,對(duì)于國(guó)民經(jīng)濟(jì)的貢獻(xiàn)度不斷提升,是經(jīng)濟(jì)新常態(tài)下我國(guó)經(jīng)濟(jì)發(fā)展的戰(zhàn)略性新興產(chǎn)業(yè)。2015年我國(guó)版權(quán)產(chǎn)業(yè)的行業(yè)增加值已超過5萬億元,占全國(guó)GDP比重達(dá)到7.3%,版權(quán)產(chǎn)業(yè)已成為我國(guó)經(jīng)濟(jì)的支柱性產(chǎn)業(yè)之一,對(duì)于促進(jìn)我國(guó)民族文化的傳播和增強(qiáng)國(guó)家核心競(jìng)爭(zhēng)力都具有重要作用。進(jìn)入到數(shù)字網(wǎng)絡(luò)時(shí)代,一方面,由于我國(guó)版權(quán)文化產(chǎn)業(yè)的快速發(fā)展,現(xiàn)實(shí)中數(shù)字版權(quán)交易的需求不斷增長(zhǎng);另一方面,現(xiàn)有版權(quán)制度面對(duì)數(shù)字技術(shù)沖擊沒有作出及時(shí)有效的變革,特別是數(shù)字版權(quán)交易機(jī)制的缺失和不足,導(dǎo)致數(shù)字版權(quán)市場(chǎng)交易通道不暢,造成數(shù)字版權(quán)的海量交易難題。隨之而來的是我國(guó)數(shù)字版權(quán)侵權(quán)糾紛案件不斷上升,這抑制了我國(guó)版權(quán)產(chǎn)業(yè)的健康發(fā)展。為解決數(shù)字版權(quán)的海量交易難題,本研究探討建立和完善數(shù)字版權(quán)財(cái)產(chǎn)權(quán)交易機(jī)制。以法律制度與技術(shù)發(fā)展的相互作用為視角,研究數(shù)字版權(quán)交易的權(quán)利流轉(zhuǎn)、定價(jià)機(jī)制、支撐機(jī)制和保障機(jī)制。在權(quán)利流轉(zhuǎn)上,分析了出售、出租和融資模式,并將新興的版權(quán)證券化作為一種版權(quán)財(cái)產(chǎn)權(quán)實(shí)現(xiàn)途徑,納入到數(shù)字版權(quán)的交易方式中。在定價(jià)機(jī)制上,定價(jià)是交易的前提,提出以大數(shù)據(jù)分析來改進(jìn)傳統(tǒng)收益法,以建立完善的數(shù)字版權(quán)交易平臺(tái)來改進(jìn)市場(chǎng)法的新思路。在支撐機(jī)制上,構(gòu)建數(shù)字版權(quán)交易平臺(tái)作為交易樞紐和技術(shù)支撐。在保障機(jī)制上,綜合運(yùn)用版權(quán)交易公示制度來明晰產(chǎn)權(quán),并利用技術(shù)保護(hù)措施來防止非法使用行為�？傊�,從法律制度和技術(shù)利用兩方面來構(gòu)建數(shù)字版權(quán)交易機(jī)制,以期緩解現(xiàn)有的版權(quán)糾紛,提高數(shù)字版權(quán)交易的效率和安全,推動(dòng)我國(guó)數(shù)字版權(quán)產(chǎn)業(yè)的持續(xù)健康發(fā)展。
[Abstract]:At present, the economic development of our country is in the new normal stage. Implementing the strategy of innovation-driven development and promoting the transformation and upgrading of industrial structure has become an inevitable choice for the economic development of our country. As an important part of the intellectual property economy, the copyright industry is an important part of the intellectual property economy. In 2015, the industry added value of China's copyright industry exceeded 5 tillion yuan. The copyright industry has become one of the pillar industries in China's economy, which plays an important role in promoting the dissemination of national culture and enhancing the core competitiveness of the country. In the digital network era, on the one hand, the copyright industry has become one of the pillar industries in our economy. Due to the rapid development of the copyright culture industry in China, the demand for digital copyright transactions is increasing in reality. On the other hand, the existing copyright system has not made timely and effective changes in the face of the impact of digital technology. Especially, the lack and insufficiency of the digital copyright trading mechanism lead to the difficulty of the digital copyright trading channel, which leads to the huge problem of digital copyright transaction. The following is the rising number of digital copyright infringement disputes in our country. This has restrained the healthy development of the copyright industry of our country. In order to solve the problem of massive transaction of digital copyright, this study explores the establishment and perfection of the transaction mechanism of digital copyright property right, from the perspective of the interaction between legal system and technological development. This paper studies the right circulation, pricing mechanism, supporting mechanism and safeguard mechanism of digital copyright transaction. In the right circulation, it analyzes the mode of sale, lease and financing, and takes the emerging copyright securitization as a way to realize the copyright property right. In terms of pricing mechanism, pricing is the premise of transaction. Big data analysis is proposed to improve the traditional income method. In order to establish a perfect digital copyright trading platform to improve the new ideas of market law. In support mechanism, construct digital rights trading platform as a trading hub and technical support. Comprehensive use of copyright transaction publicity system to clarify property rights, and the use of technical protection measures to prevent illegal use. In short, from the legal system and the use of technology to build a digital copyright trading mechanism, in order to alleviate the existing copyright disputes, To improve the efficiency and safety of digital copyright trading and promote the sustainable and healthy development of digital rights industry in China.
