【摘要】：當今社會,諸多背叛婚姻的不良現(xiàn)象破壞著人們對婚姻家庭的美好期許。為了填補法律救濟的空白、提高婚姻安全感,越來越多夫妻選擇簽訂“夫妻忠實協(xié)議”來維護婚姻關(guān)系的穩(wěn)定。但是,由于我國現(xiàn)行法對夫妻忠實協(xié)議的有關(guān)問題一直保持著含糊不清的態(tài)度,使得涉及“夫妻忠實協(xié)議”的案件一直是司法實踐中“同案不同判”之典型。在夫妻之間忠實、專一的品質(zhì)備受考驗的時代背景下,筆者認為很有必要對夫妻忠實協(xié)議的有關(guān)爭議論題進行系統(tǒng)梳理,找到一條有效規(guī)制和實現(xiàn)夫妻忠實協(xié)議效力的合理路徑,真正發(fā)揮夫妻忠實協(xié)議對婚姻安全、穩(wěn)定的保障作用。本文主要包含四章:第一章從司法實踐中的案件判決破題,解析夫妻忠實協(xié)議的現(xiàn)實樣態(tài)和所面臨的困境,為接下來的法理分析作鋪墊。第二章從婚姻本質(zhì)的角度、法律和道德的角度,探討夫妻忠實協(xié)議的法律性質(zhì)。第三章通過歸納和評述學(xué)界中有關(guān)夫妻忠實協(xié)議效力認定的若干觀點,得出夫妻忠實協(xié)議具有法律效力的結(jié)論。同時,進一步論述了認可夫妻忠實協(xié)議有效的正當性,并闡明了夫妻忠實協(xié)議與《合同法》的密切關(guān)系和其違約金性質(zhì)。第四章結(jié)合我國現(xiàn)行法的相關(guān)規(guī)定,就如何完善當前夫妻忠實問題的立法、如何更好地使夫妻忠實協(xié)議發(fā)揮對婚姻家庭的增益作用,提出了若干建議。
[Abstract]:Nowadays, many bad phenomena of betraying marriage destroy people's expectation of marriage and family. In order to fill the gap of legal remedy, improve the sense of security of marriage. More and more husband and wife choose to sign "husband and wife loyalty agreement" to maintain the stability of marital relationship. However, due to the current law of our country, there has always been a vague attitude towards the issues related to the agreement of loyalty between husband and wife. So that the case involving the "agreement of loyalty between husband and wife" has always been a typical case of "different judgments of the same case" in judicial practice. Under the background of the test of fidelity and specificity between husband and wife, the quality of loyalty has been tested. The author thinks that it is necessary to systematically comb the controversy about the faithful agreement of husband and wife, to find a reasonable way to regulate and realize the validity of the faithful agreement of husband and wife effectively, and to give full play to the security of marriage by the faithful agreement of husband and wife. This paper mainly includes four chapters: the first chapter analyzes the reality of the faithful agreement between husband and wife and the dilemma they face from the judicial practice. The second chapter from the point of view of the nature of marriage, legal and moral perspective. The third chapter concludes that husband and wife loyalty agreement has legal effect by summarizing and commenting on some viewpoints about the validity of husband and wife loyalty agreement in academic circles. Further discusses the validity of the validity of the recognition of the agreement of loyalty between husband and wife, and clarifies the close relationship between the agreement and the contract law and the nature of the liquidated damages. Chapter 4th combines with the relevant provisions of the current law of our country. This paper puts forward some suggestions on how to perfect the legislation on the problem of husband and wife loyalty and how to make the agreement of loyalty between husband and wife play a better role in the development of marriage and family.
