【摘要】：世界經(jīng)濟發(fā)展需要更多能源確保經(jīng)濟的繁榮。據(jù)2016年《BP世界能源統(tǒng)計年鑒》報告,連續(xù)十五年中國都是全球最大的能源增量市場。另外,國際石油市場的疲軟,使得能源儲量豐富的烏茲別克斯坦國家也亟待開辟新的能源市場。在這樣的背景下研究中烏能源合作法律制度,對促進中烏兩國各自的經(jīng)濟發(fā)展、實現(xiàn)共贏是十分有必要的。文章首先介紹了中烏能源合作的歷史基礎和時代背景、合作的必要性和可行性、中烏國內(nèi)能源法律制度。其次,分析了中烏能源合作遵循的法律原則、法律依據(jù)、法律方法及其特點、中烏雙邊能源合作法律制度和中烏共同參與區(qū)域能源合作組織的現(xiàn)狀后,提出了中烏能源合作法律制度存在的問題。再次,研究了國際能源之雙邊、區(qū)域和多邊能源合作法律制度,分析了其對中烏能源合作法律制度建設帶來的啟示。最后,從雙邊、區(qū)域、多邊能源合作法律制度以及構建新的國際能源合作法律制度四方面提出了對中烏能源合作法律制度的完善建議。通過對中烏能源合作法律制度的現(xiàn)狀、不足和國際能源合作法律制度進行研究的基礎上,文章一是總結(jié)了中烏雙邊能源合作法律制度存在的不足,并提出了針對性的解決措施。二是從區(qū)域能源的相關方面對中烏區(qū)域能源合作法律制度提出了完善措施。三是借鑒目前國際多邊能源合作法律制度完善中烏能源合作法律制度。四是從創(chuàng)建新的國際能源合作法律制度的角度進行思考,建議中烏建設能源關稅同盟、能源應急機制和能源環(huán)境影響評估機制,促使中烏之間的能源合作法律制度更加完善。
[Abstract]:World economic development needs more energy to ensure economic prosperity. According to the 2016 "BP World Energy Statistics Yearbook" report, China is the world's largest energy incremental market for 15 consecutive years. Due to the weakness of the international oil market, Uzbekistan, which has abundant energy reserves, needs to open up a new energy market. In this context, the legal system of energy cooperation between China and Uzbekistan is studied. It is necessary to promote the economic development of China and Ukraine and realize win-win situation. Firstly, the paper introduces the historical basis and background of energy cooperation between China and Ukraine, the necessity and feasibility of cooperation. Secondly, it analyzes the legal principles, legal basis, legal methods and characteristics of energy cooperation between China and Ukraine. After the legal system of bilateral energy cooperation between China and Ukraine and the status quo of the joint participation of China and Ukraine in regional energy cooperation organizations, the problems existing in the legal system of energy cooperation between China and Ukraine are put forward. Thirdly, the bilateral international energy is studied. Regional and multilateral energy cooperation legal system, analysis of the legal system of energy cooperation between China and Ukraine brings enlightenment. Finally, from bilateral, regional. Multilateral energy cooperation legal system and the construction of a new legal system of international energy cooperation proposed to improve the legal system of energy cooperation between China and Ukraine through the status quo of the legal system of energy cooperation between China and Ukraine. On the basis of the research on the legal system of international energy cooperation, the first part summarizes the shortcomings of the legal system of bilateral energy cooperation between China and Ukraine. And put forward the targeted measures. Second, from the relevant aspects of regional energy to improve the legal system of regional energy cooperation between China and Ukraine. Third, draw lessons from the current international multilateral energy cooperation legal system to improve energy between China and Ukraine. Fourth, from the point of view of creating a new legal system of international energy cooperation. It is suggested that China and Ukraine should establish an energy customs union, an energy emergency mechanism and an energy environment impact assessment mechanism, so as to make the legal system of energy cooperation between China and Ukraine more perfect.
