【摘要】：隨著經濟全球化的不斷推進和互聯網的持續(xù)發(fā)展,我們的生活已經越來越離不開電子商務,電子商務已經融入了我們的日常生活。網絡跨境代購作為電子商務的一部分,也在不斷發(fā)展,加之其便捷、高效、增值業(yè)務豐富等特點,相比于傳統的電子商務,受到了更多消費者的親睞。我國在規(guī)范網絡跨境代購方面作出了很多努力,進行了很多嘗試,但就當前情況來分析,還有很多不足,還沒有形成一個完整的法律法規(guī),只能夠依照電子商務的一般法律法規(guī)對有關問題進行處理。可是網絡跨境代購除具備電子商務、網絡購物的一般特點,也有著其自身特殊性,依照電子商務的一般法律法規(guī)往往不能做到對癥下藥。所以對網絡跨境代購相關法律問題進行探究,建立一個行業(yè)獨有的、相對完善的法律法規(guī)對其進行規(guī)制意義重大。除引言和結語以外,本文共分為五個部分。第一部分主要通過對三方主體和兩個法律關系的分析探究了網絡跨境代購的法律性質,三方主體是指網絡跨境代購的實際消費者、代購商和商品的實際銷售者,兩個法律關系是指商品實際銷售商與代購商之間的法律關系和代購商與商品實際消費者之間的法律關系。第二部分主要分析了網絡跨境的代合同的成立。網絡跨境代購合同的成立主要是要約和承諾生效及撤銷的問題。第三部分主要分析網絡跨境代購的兩種法律風險及風險的防范措施。兩種風險指的是信用風險和消費者權利保護的風險。第四部分著重分析了網絡跨境代購糾紛的兩種解決機制,一是協商解決,二是訴訟解決。協商解決是出現爭端后最普遍的一種解決方式,訴訟解決則是窮盡協商解決方式后的一種國家強制力保護的解決方式。第五部分主要分析了海關部門和非海關部門監(jiān)管現狀,并在此基礎上提出了完善我國網絡跨境代購監(jiān)管的具體建議。
[Abstract]:With the continuous promotion of economic globalization and the continuous development of the Internet, our lives have become more and more inseparable from e-commerce. E-commerce has been integrated into our daily life. As a part of E-commerce, cross-border online purchasing is also developing, in addition to its convenient, efficient, value-added business and other characteristics. Compared with the traditional e-commerce, it has been favored by more consumers. Our country has made a lot of efforts and made a lot of attempts in regulating cross-border purchase of the network, but there are still many shortcomings in the analysis of the current situation. There is not yet a complete laws and regulations, can only be in accordance with the general laws and regulations of e-commerce to deal with the relevant issues. However, cross-border online shopping in addition to e-commerce, the general characteristics of online shopping. Also has its own particularity, according to the general laws and regulations of e-commerce often can not do the right medicine. So the network cross-border purchase related legal issues to explore the establishment of an industry unique. The relatively perfect laws and regulations are of great significance to its regulation. In addition to the introduction and conclusion. This paper is divided into five parts. The first part mainly through the analysis of the tripartite subject and the two legal relations to explore the legal nature of cross-border online purchase, the tripartite subject refers to the actual consumers of cross-border online purchasing. Agents and actual sellers of goods. The two legal relations refer to the legal relationship between the actual seller of goods and the agent buyer and the legal relationship between the agent buyer and the actual consumer of the commodity. The second part mainly analyzes the establishment of the cross-border contract on the Internet. The third part mainly analyzes the two kinds of legal risks and the precautionary measures of the network cross-border purchase. The two kinds of risks refer to the credit risk and consumers. The risk of right protection. Part 4th focuses on the analysis of the network cross-border purchase dispute settlement mechanism. One is the settlement through negotiation, the other is the settlement of litigation, which is the most common way of settlement after the emergence of disputes. Litigation settlement is a national compulsory protection solution after exhaustive negotiation. Part 5th mainly analyzes the current situation of customs department and non-customs department supervision. On this basis, the paper puts forward some concrete suggestions on how to improve the supervision of cross-border purchasing in China.
