【摘要】:APP出行平臺是指利用互聯(lián)網(wǎng)為依托所構(gòu)建的線上進行車輛與駕駛員的信息整合,線下進行出租車、代駕、專車等出行服務(wù)的信息平臺,隨著社會經(jīng)濟的發(fā)展APP出行平臺業(yè)務(wù)已成為人們生活中離不開的一部分,但其作為一種新興的行業(yè),迅猛的發(fā)展隨之帶來的是各式各樣的法律問題,其中,尤以駕駛員與APP平臺公司之間的法律關(guān)系最為突出。然而在我國的司法實踐中,對于二者法律關(guān)系的認定眾說紛紜。本文的第一章簡要介紹了四個相似的案件,四份結(jié)論不同的判決引出了本文的爭議焦點,即APP出行平臺公司與駕駛員是勞動合同關(guān)系、雇傭合同關(guān)系還是居間合同關(guān)系;本文第二章對有關(guān)APP出行平臺業(yè)務(wù)的規(guī)章進行制度分析,指出規(guī)章并未對二者法律關(guān)系做具體界定,反而使其更加模糊;本文第三章提出筆者自身的論點,因APP出行平臺業(yè)務(wù)本身的復(fù)雜性,對平臺公司與駕駛員法律關(guān)系的界定應(yīng)采用類型化加以分析,在“代駕”與“?燔嚒蹦J较露邞(yīng)為雇傭合同關(guān)系,在“出租車”與“順風(fēng)車”模式下二者應(yīng)為居間合同關(guān)系;本文的最后一章主要提出APP出行平臺公司與駕駛員法律關(guān)系界定所衍生的有關(guān)交通事故責任承擔主體之確定的問題,使本文的理論分析回歸實踐,對于相關(guān)案件的解決有一定的現(xiàn)實意義。
[Abstract]:APP travel platform is constructed based on the information integration refers to the use of the Internet line of vehicles and drivers, taxi line, on behalf of the drive, car and other travel information service platform, with the development of social economy has become a platform for business travel APP cannot do without the part of people's life, but as a kind of new in the industry, the rapid development and brought the legal issues, every kind of which, especially in the legal relationship between the drivers and the APP platform is the most prominent. However, in the judicial practice of our country, to affirm the legal relationship between the two Public opinions are divergent.. The first chapter briefly introduces the four similar cases, four a conclusion different judgment leads to the focus of dispute in the APP platform and the driver is travel company labor contract, employment contract or contract relationship; the second chapter is on APP travel platform business rules and system analysis, pointed out that the legal relationship between the two regulations did not make specific definition, but make it more fuzzy; in the third chapter, the author puts forward its own argument, because the complexity of APP travel platform business itself, the definition of legal relationship between the company and the platform driver should use the type of analysis, in the "drive" and "special train" mode two for employment contract relationship, in the "taxi" and "ride" mode two for intermediary contract relationship; the last chapter of this paper mainly puts forward the traffic accident responsibility subject of the problem of determining the legal relationship between APP company and the driver defined travel platform from the theoretical analysis, the practice, has a certain practical significance for solving the cases.
