【摘要】:經濟全球一體化不斷融合,交通運輸業(yè)的發(fā)展更是快速。而行業(yè)的飛速發(fā)展,相關法律規(guī)定卻并未來得及完善。由此導致現(xiàn)實中的形式越來越嚴峻,機鬧的新聞不絕于耳。近兩年,人民日報就多次報道了類似新聞。而這些新聞頻發(fā)是否是由相關法律法規(guī)建設的不完善所導致,值得探討與研究。本文就此問題研究了國際航班延誤后,承運人方面所應負擔的責任。本文主要內容可劃分為四個部分剖析,且文章前有引言,后附結語。主要如下:通過引言部分引導出航班延誤所導致的現(xiàn)實問題所在以及解決這些問題的必要性來說明寫作目的。第一部分理清國際航班及航班延誤的概念,逐步導出文章的中心概念及關鍵詞匯,為后文做鋪墊。第二部分重點討論《華沙公約》與《蒙特利爾公約》。主要從歸責的原則、免責的事由和賠償限額等角度分析其內容,而就國際條約規(guī)定的問題所在也進行深入討論。第三部分以歐盟、美國為例,討論其相關法律規(guī)定是怎樣辨析航班延誤概念,相關責任承擔,及具體細化到現(xiàn)實中賠償標準等問題。并討論其在實踐操作中所出現(xiàn)的問題。第四部分反思我國法律現(xiàn)狀,研究我國現(xiàn)有的相關法律規(guī)定,思考其現(xiàn)實狀況,分析其利弊,試給出現(xiàn)實化的立法建議。本文的創(chuàng)新點在于試圖從現(xiàn)實生活存在的問題入手,以問題為導向,研究航班延誤相關法律問題。在導師的建議下,從承運人角度著手,研究國際航班延誤后責任承擔問題,更為細化與具體。并就航班延誤的概念進行討論,通過比較分析法來找出我國相關法律的不足之處。最后,探索性給出完善建議,嘗試給出可操作性較強的解決方案,例如制定明確可衡量的賠償標準及完善延誤險等方法。
[Abstract]:The continuous integration of global economic integration, the development of the transport industry is more rapid. While the industry's rapid development, the relevant laws and regulations are the future and perfect. Thus leading to the reality in the form of more and more serious, the news can be heard without end machine trouble. In recent years, people's Daily Times reported similar news. These events whether it is by the construction of related laws and regulations is not perfect resulting, worthy of discussion and study. This paper studies the international flight delays, the carrier should bear the responsibility. The main contents of this paper can be divided into four parts and the analysis, the introduction, after the conclusion. The main results are as follows: the report of introduction a necessary flight delays caused by the problems and solve these problems to explain the purpose of writing. The first part clarifies the concept of international flights and flight delays, gradually derived paper The central concepts and key words of the chapter, to pave the way for the later. The second part focuses on the "Warsaw Convention" and "the Montreal convention. Mainly from the imputation principle, the reasons and the limitation of exemption angle analysis of their content and international treaty problem were discussed. The third part of the European Union the United States, for example, discuss the relevant laws and regulations is how to discriminate the flight delay related concept, responsibility, and in particular to the reality in the standard of compensation and other issues. And discuss the problems in the practice of the operation. On the fourth part of our national law status, research on China's existing relevant laws and regulations, thinking of the reality the status, analyzes its advantages and disadvantages, try to legislative proposals appear materialized. The innovation of this paper is to exist from real life problems, problem oriented research, flight delays related legal problems. In the guide The teacher's advice, proceed from the angle of the carrier, the international flight delays liability issues, more detailed and specific. And the concept of flight delay was discussed, through comparative analysis to identify the deficiencies of China's relevant laws. Finally, we explore the perfect proposal, tries to give the solution of strong, such as setting clear measurable compensation standard and perfect delay insurance method.
