【摘要】：生態(tài)犯罪是指違反生態(tài)刑事法律規(guī)范,嚴(yán)重破壞生態(tài)安全的行為。在風(fēng)險(xiǎn)社會(huì)背景下,生態(tài)環(huán)境破壞是典型的現(xiàn)代型風(fēng)險(xiǎn)。我國(guó)現(xiàn)行有關(guān)破壞生態(tài)環(huán)境的犯罪及刑事處罰規(guī)范分散在刑法典及其司法解釋及其他部門法規(guī)定的附屬刑法當(dāng)中,學(xué)界將其界定為環(huán)境犯罪,但生態(tài)犯罪和環(huán)境犯罪在犯罪客體即法益侵害上是有重大區(qū)別的。傳統(tǒng)的環(huán)境犯罪以人類的人身法益和財(cái)產(chǎn)法益為侵害法益,而生態(tài)犯罪則以生態(tài)安全法益為侵害法益,以是否嚴(yán)重破壞生態(tài)安全為入罪的要件。一生態(tài)破壞行同時(shí)造成為生態(tài)安全危害、損害和人員傷亡或財(cái)產(chǎn)損失的嚴(yán)重后果,則符合想象競(jìng)合犯的歸罪要件。同時(shí),生態(tài)系統(tǒng)、環(huán)境、自然資源三者之間存在天然的關(guān)聯(lián)性,不可能進(jìn)行人為的分割,分別進(jìn)行刑事法律制度的設(shè)計(jì)構(gòu)筑刑事保護(hù)法網(wǎng),只能采取統(tǒng)一立法。由此,我國(guó)未來生態(tài)犯罪刑事立法應(yīng)當(dāng)要回應(yīng)風(fēng)險(xiǎn)社會(huì)的生態(tài)風(fēng)險(xiǎn)對(duì)生態(tài)犯罪刑事立法帶來的沖擊與挑戰(zhàn),從風(fēng)險(xiǎn)防范的理念出發(fā)選擇生態(tài)犯罪的刑法治理路徑。設(shè)置“危害生態(tài)安全罪”這一類罪,置于現(xiàn)行刑法第六章第六節(jié)規(guī)定的“破壞環(huán)境資源保護(hù)罪”當(dāng)中,在其規(guī)定的14個(gè)罪名下,增加罪狀:造成嚴(yán)重生態(tài)破壞,破壞生態(tài)平衡,危及生態(tài)安全的,構(gòu)成危害生態(tài)安全罪,處以相應(yīng)的刑罰。同時(shí)增加破壞濕地罪、引進(jìn)有害外來物種罪,非法濫用轉(zhuǎn)基因生物技術(shù)罪等。在此理念基礎(chǔ)上構(gòu)建生態(tài)刑法體系,促進(jìn)刑法的生態(tài)安全保護(hù)功能。
[Abstract]:The ecological crime refers to violations of the ecological criminal law, serious damage to the ecological security. In the risk society, the destruction of the ecological environment is the modern risk typical. The destruction of ecological environment crime and criminal punishment in criminal law norms scattered affiliated criminal code and judicial interpretation and other departments of law, science it is defined as the world environmental crime, but ecological crime and environmental crime in the criminal object that Rechtsgut is a major difference. The traditional environmental crime in the human rights and personal property rights as the infringement of legal interests, and ecological crime on the ecological security law is against the law, to the ecological safety is serious damage to the crime elements. A bank also caused ecological damage to ecological safety hazards, serious damage and casualties or property losses, with the blame to the imaginative joinder of offenses. At the same time, ecosystem, environment, there is a correlation between the three natural natural resources, can not be artificially split, are designed respectively in the criminal law system of criminal law protection to build, can only take the uniform legislation. Therefore, China's future ecological crime criminal legislation should respond to the ecological risk of social risk and challenge of ecological the criminal legislation of the crime of impact, the choice of criminal law governance path of ecological crime from the risk prevention concept. "Endanger the ecological security crime" of this kind of crime in the current criminal law, the sixth chapter of sixth regulations of environmental crime, increase the crime of 14 counts of its provisions, resulting in: serious ecological damage, destroy the ecological balance and endanger the ecological safety, endanger the ecological security crime, a corresponding punishment. At the same time increase the crime of destruction of wetlands, the introduction of the crime of harmful alien species, The crime of illegal abuse of genetically modified biological technology, and so on. On the basis of this concept, the ecological criminal law system is constructed to promote the ecological security and protection function of the criminal law.
