【摘要】：由于傳統(tǒng)司法觀念的影響以及法律制度某些方面的缺失,刑訊逼供現(xiàn)象在我國(guó)的刑事司法實(shí)踐中相當(dāng)普遍,已對(duì)社會(huì)主義法制建設(shè)事業(yè)造成了極大損害,這就使得從理論上探討、完善刑訊逼供的應(yīng)對(duì)策略在當(dāng)前的中國(guó)顯得更為迫切。梳理中國(guó)歷史中的刑訊逼供形態(tài)及其流變,在此基礎(chǔ)上探尋中國(guó)古代專制文化造成的有礙司法公正的觀念的成因,有助于加深對(duì)糾正刑訊逼供"頑疾"的認(rèn)識(shí)。
[Abstract]:Because of the influence of the traditional judicial concept and the lack of some aspects of the legal system, the phenomenon of extorting confessions by torture is quite common in the criminal judicial practice of our country, which has caused great harm to the cause of the construction of the socialist legal system. This makes it more urgent to explore theoretically and perfect the strategy of extorting confessions by torture. Combing the forms and changes of extorting confessions by torture in the history of China, on the basis of which, the causes of the idea of obstructing judicial justice caused by the autocratic culture in ancient China are explored, which is helpful to deepen the understanding of correcting the "stubborn diseases" of extorting confessions by torture.
