【摘要】：唐、金、宋法令,把"聽(tīng)""斷"作為刑事審判的兩個(gè)過(guò)程、兩個(gè)環(huán)節(jié)加以區(qū)分;宋初編書(shū),也將"聽(tīng)訟""決獄"分別編排,構(gòu)成了宋代"鞫讞分司"的制度基礎(chǔ)與觀念基礎(chǔ)。"鞫讞分司"發(fā)端于地方州府新設(shè)的司理參軍掌獄訟勘鞫,擴(kuò)展至錄事參軍介入鞫獄;與唐制相比,原司法參軍"鞫獄定刑"的職掌被分割,僅剩"議法斷刑"。"鞫讞分司"的進(jìn)一步發(fā)展是,大理寺、御史臺(tái)、戶(hù)部等中央機(jī)構(gòu)皆行"鞫讞分司"制,其中大理寺尤為典型;且其職掌分化依托機(jī)構(gòu)分立,更形體制機(jī)制化。
[Abstract]:The Tang, Jin and Song decrees made "hearing" and "breaking" as two processes of criminal trial, and the two links were distinguished; in the early Song Dynasty, the book "hearing" and "sentencing" were also arranged separately. It formed the basis of the system and the idea of the division of the department in the Song Dynasty. "the division of the division of the department and the department of justice" originated in the newly set up of the local state capital, and expanded to the entry of the military into the prison system, which was compared with the system of the Tang Dynasty. The former judicial enlistment in the army was divided into two parts, only "discussing the law and deciding the punishment". The further development of the division was that the Dali Temple, the imperial court, the household department and other central agencies all carried out the system of "division of the department", among which the Dali Temple was particularly typical; And its division depends on the division of the organization, more institutional system.
