憲政制度是目前世界上多數(shù)國家認可的政治模式。在憲政國家里，憲法決定國家的政治結構，是調整政府和個人之間關系的根本準則，也是判定其他法律法規(guī)的依據(jù)。美國是最早擁有成文憲法的國家，憲法本身的高度穩(wěn)定和修正案的相對靈活是其建國以來國內(nèi)政治能較為平穩(wěn)地面對不斷發(fā)展的社會狀況的重要因素。第十八條禁酒令是美國憲法史上唯一一條被廢除的憲法修正案，其產(chǎn)生的時代也是法制體系從近代走向現(xiàn)代的過渡時期，對其產(chǎn)生背景及其造成的影響的研究或許能有助于我們更好地理解憲法修正所應依據(jù)的原則。 本文以起源于歐洲的人民主權和社會契約論作基石；以世界上第一部成文憲法美國憲法基本精神和目的為價值導向，將美國憲法中第十八條修正案置身于其產(chǎn)生的歷史背景和美國特有的憲法文化和憲政制度中，具體的討論其產(chǎn)生與廢除的必然性。憲法作為規(guī)范性文件，在面對具體的社會問題時，憲法修正案的制定不能為了統(tǒng)一的道德價值體系而違背其基本精神，在采納“多數(shù)人”意愿的時候，不應對少數(shù)人的自由權利進行粗暴干涉，否則只會損害憲法的權威，造成憲法的事實無效。 本文共分四章。 第一章簡要回顧了歐洲啟蒙思想家對社會契約，人民主權和權力制衡的共同認...
