赫梯國(guó)家引渡的歷史研究

【摘要】： 赫梯國(guó)家的引渡有著悠久的歷史,大量的赫梯文獻(xiàn)留下了這方面的記載。本文以公元前兩千紀(jì)赫梯國(guó)家與周邊各政治實(shí)體之間的引渡為研究對(duì)象,歸納赫梯文獻(xiàn)中的引渡術(shù)語(yǔ);從梳理文獻(xiàn)中的引渡入手,探討赫梯國(guó)家引渡的起始時(shí)間、演變過(guò)程及原因;分析這種歷史現(xiàn)象的復(fù)雜性,研究引渡機(jī)制與引渡活動(dòng)的關(guān)系,并從青銅時(shí)代晚期整個(gè)近東地區(qū)的區(qū)域視野下審視這一研究對(duì)象,全面評(píng)價(jià)赫梯國(guó)家引渡的歷史地位。 以下是各個(gè)部分的具體內(nèi)容: 緒論:介紹選題意義,總結(jié)研究現(xiàn)狀,并對(duì)關(guān)鍵術(shù)語(yǔ)進(jìn)行概念上的界定。 第一章:歸納赫梯文獻(xiàn)中的引渡術(shù)語(yǔ),分類(lèi)整理赫梯文獻(xiàn)中關(guān)于引渡的記載情況。 第二章:根據(jù)赫梯文獻(xiàn)的記載情況,確定目前最早的引渡記載出現(xiàn)的時(shí)間,對(duì)赫梯國(guó)家的引渡進(jìn)行歷時(shí)梳理,理清其產(chǎn)生和演變的過(guò)程并討論其產(chǎn)生和演變的原因。 第三章:對(duì)赫梯國(guó)家的引渡做出歷史評(píng)價(jià)。 結(jié)論:從赫梯文獻(xiàn)來(lái)看,赫梯國(guó)家的引渡很可能在赫梯古王國(guó)晚期,至遲在中王國(guó)早期已經(jīng)出現(xiàn),早于目前法學(xué)界和國(guó)際關(guān)系學(xué)界所認(rèn)可的世界上最早的引渡記載的時(shí)間,而且發(fā)展比較成熟。赫梯國(guó)家引渡的出現(xiàn)有政治和經(jīng)濟(jì)兩方面的原因,并且隨著國(guó)內(nèi)外局勢(shì)的不斷變化,引渡也經(jīng)歷了復(fù)雜的演變過(guò)程。很可能從古王國(guó)晚期直至帝國(guó)滅亡,引渡問(wèn)題始終是赫梯外交中不可缺少、無(wú)法回避的重要內(nèi)容,甚至在赫梯國(guó)王的對(duì)內(nèi)統(tǒng)治中也占據(jù)重要地位。赫梯國(guó)家的引渡包含豐富的歷史內(nèi)容,赫梯與其他國(guó)家的引渡機(jī)制是赫梯與當(dāng)時(shí)國(guó)際社會(huì)聯(lián)系的一個(gè)紐帶,也是赫梯文明取得的成就之一,很可能在不同階段、不同程度地在維護(hù)這一地區(qū)的政治穩(wěn)定,加強(qiáng)國(guó)際交往方面發(fā)揮了積極作用,同時(shí)也在一定程度上有利于維護(hù)相關(guān)國(guó)家的經(jīng)濟(jì)利益。
[Abstract]:The extradition of the Hittian countries has a long history, and a large number of Herttian literature has left a record in this regard. In this paper, the extradition between the two countries and the surrounding political entities in 2000 BC is studied, and the extradition terms in Herttian literature are summarized. By combing the extradition in the literature, this paper probes into the starting time, evolution process and reasons of extradition in Herttian countries. This paper analyzes the complexity of this historical phenomenon, studies the relationship between extradition mechanism and extradition activities, examines this research object from the regional perspective of the whole near East region in the late Bronze Age, and comprehensively evaluates the historical status of extradition in Hittian countries. The following are the specific contents of each part: introduction: introducing the significance of the topic, summarizing the status quo of the research, and defining the key terms conceptually. Chapter one: summarize the extradition terms in Herttian literature and sort out the records of extradition in Herttian literature. Chapter two: according to the records of Herttian literature, the author determines the earliest extradition record at present, combs the extradition in Herttian countries, clarifies the process of its emergence and evolution, and discusses the causes of its emergence and evolution. Chapter three: make a historical evaluation of the extradition of the Hittian countries. Conclusion: judging from the literature of the Hittists, extradition of the countries of the Hittists is likely to have occurred in the late part of the ancient Kingdom of Hittitia, and not later than in the early days of the Middle Kingdom, earlier than the earliest extradition record in the world recognized by the legal and international relations circles at present, And the development is relatively mature. The emergence of extradition in Hittian countries has political and economic reasons, and along with the changing situation at home and abroad, extradition has also experienced a complex process of evolution. Probably from the late ancient kingdom to the end of the Empire, extradition has always been an indispensable and unavoidable content in the diplomacy of Hittit, and even occupied an important position in the internal rule of King Hertti. The extradition of the Hittian countries contains a wealth of historical content, and the extradition mechanism between Hercules and other countries is a link between him and the international community at that time, and it is also one of the achievements of the Hittian civilization, which is likely to take place at different stages. To some extent, it has played an active role in maintaining the political stability of the region and strengthening international exchanges, and to a certain extent it is also conducive to safeguarding the economic interests of the countries concerned.
