【摘要】：由于中國天下秩序觀與西方國際法體系的原理不同,宗藩體制的"屬邦自主"慣例無法比照《國際法》"宗主國"與"屬國"的定義,使清政府先后丟失琉球與越南的宗主權(quán)。為了保住對朝鮮的宗主權(quán),清政府試圖以宗藩禮儀,套用《國際法》對"宗主國"的解釋,加強(qiáng)控制朝鮮內(nèi)政外交,卻使朝鮮懷疑中國動機(jī)不良,欲否定其自主地位。樸定陽出使美國之事,正是清政府檢驗中朝宗藩關(guān)系是否被歐美各國所接受,也是朝鮮向國際社會宣稱"自主之國"的絕佳機(jī)會。樸定陽使節(jié)團(tuán)雖成功擺脫"三端"限制,但在李鴻章的斡旋下,朝鮮未能達(dá)到"自主"之訴求,反而讓中朝兩國的爭端趨向表面化,也讓朝鮮決心引入日本勢力,牽制中國,埋下甲午戰(zhàn)爭的隱患。
[Abstract]:Because of the difference between the Chinese view of world order and the principles of the western international law system, the practice of "subordinate autonomy" in the suzerain-vassal system could not be compared with the definitions of "sovereign state" and "dependent state" in "international law", which led the Qing government to lose the sovereignty of Ryukyu and Vietnam successively. In order to keep the sovereignty over Korea, the Qing government tried to apply the interpretation of "Suzerain" to strengthen the control of North Korea's internal and foreign affairs, but made the DPRK suspect that China had bad motive and wanted to deny its autonomous status. Park Dingyang's mission to the United States was a perfect opportunity for the Qing government to test whether the suzerain-vassal relations between China and North Korea were accepted by Europe and the United States, and to claim to the international community that Korea was an independent country. Although Park Dingyang successfully freed the regiment from the "three ends" restriction, under the mediation of the Li Hongzhang, North Korea failed to achieve the demand of "independence". On the contrary, the dispute between China and North Korea tended to become superficial, and North Korea was determined to introduce Japanese forces to contain China. Bury the hidden dangers of the Sino-Japanese War.
