【摘要】： 多年來學(xué)者的爭論主要集中在古代埃及究竟有沒有成文法典的存在,所以,對(duì)于古代埃及法律方面的研究,尤其是民法制度的研究,鮮有人涉及。但不管古代埃及是否存在成文法典,法律在國家的運(yùn)行和社會(huì)秩序的維持方面都一樣發(fā)揮著應(yīng)有的作用。并且,遺留下來的古代埃及文獻(xiàn)、遺物、遺跡以及古典作家著作所提供的史料都為我們研究古代埃及的法律提供了有利的證據(jù)。 通過對(duì)古埃及國家的出現(xiàn)及其發(fā)展的探究,本文明確了古埃及法律的形成和演變過程。古埃及法律包括的內(nèi)容繁多,但其中的民法制度是最為重要的。因?yàn)樗婕吧鐣?huì)生活的方方面面,包括土地的買賣和出租、契約的訂立以及婚姻和繼承等方面的內(nèi)容。通過對(duì)一些保存下來的國王的敕令、古代埃及文獻(xiàn)以及一些陶片上所記載的內(nèi)容的研究,本文對(duì)民法制度所包含的具體內(nèi)容進(jìn)行了更深入和細(xì)致的闡述。古代埃及的契約制度是伴隨著貿(mào)易的發(fā)展而不斷完善的,而它的完善又會(huì)進(jìn)一步促進(jìn)古代埃及奴隸制經(jīng)濟(jì)的發(fā)展,同時(shí)對(duì)社會(huì)生活的其他方面也有很大的影響。就此,我們可以窺見到法律層面的古代埃及文明。
[Abstract]:For many years, scholars have mainly focused on the existence of written codes in ancient Egypt. Therefore, the study of ancient Egyptian law, especially the study of civil law system, has rarely been involved. But whether ancient Egypt has a written code or not, law plays an equal role in the operation of the country and the maintenance of social order. What's more, the ancient Egyptian documents, relics, relics and historical materials provided by classical writers provide us with good evidence to study the law of ancient Egypt. By probing into the emergence and development of ancient Egypt, this paper clarifies the formation and evolution of ancient Egyptian law. The ancient Egyptian law includes many contents, but the civil law system is the most important. Because it involves all aspects of social life, including the sale and lease of land, the signing of contracts, marriage and inheritance. Through the study of some surviving royal decrees, ancient Egyptian documents and the contents recorded in some pottery pieces, this paper makes a deeper and more detailed exposition of the specific contents contained in the civil law system. The contract system of ancient Egypt was improved with the development of trade, and its perfection will further promote the development of slavery economy in ancient Egypt, at the same time, it also has a great influence on other aspects of social life. In this regard, we can see the legal level of ancient Egyptian civilization.
