【摘要】：在中世紀(jì)英國(guó),農(nóng)民家庭土地繼承盡管受不同習(xí)慣的影響而呈現(xiàn)不同的形式,但以單子(長(zhǎng)子或幼子)繼承制為主。中世紀(jì)農(nóng)民家庭土地繼承體現(xiàn)了較強(qiáng)的個(gè)人財(cái)產(chǎn)權(quán)利取向和市場(chǎng)交易特征,土地持有人可以在一定程度上改變繼承習(xí)慣,自由選擇繼承人和處置土地;有權(quán)規(guī)定被繼承人承擔(dān)供養(yǎng)非繼承人的義務(wù);有權(quán)通過(guò)與繼承人簽訂贍養(yǎng)協(xié)議,在法律框架內(nèi)維護(hù)自身的財(cái)產(chǎn)權(quán)益。這種繼承習(xí)慣的改變不僅有助于推動(dòng)英國(guó)農(nóng)民土地市場(chǎng)的發(fā)展和富裕農(nóng)民階層的興起,其蘊(yùn)含的強(qiáng)大的人口流動(dòng)推力也有利于勞動(dòng)力市場(chǎng)的發(fā)展,成為推動(dòng)以雇傭勞動(dòng)為本質(zhì)的近代資本主義農(nóng)業(yè)產(chǎn)生和發(fā)展的積極因素。
[Abstract]:In medieval England, peasant family land inheritance took on different forms under the influence of different customs, but it was dominated by single (eldest or young) inheritance system. The peasant family land inheritance in the Middle Ages embodied the strong personal property right orientation and the market transaction characteristic, the land holder can change the inheritance custom to a certain extent, freely chooses the heir and the disposition land; The right of the heirs to bear the obligation to provide for the non-heirs, and the right to maintain their property rights and interests within the legal framework through the signing of maintenance agreements with the heirs. This change in inheritance habits not only contributed to the development of the land market for British farmers and the rise of the rich peasant class, but also contributed to the development of the labour market because of the strong push of population mobility. It has become a positive factor to promote the emergence and development of modern capitalist agriculture with wage labor as its essence.
