【摘要】：19世紀(jì)的英國,資本主義獲得全面勝利,它們運(yùn)用一切手段來保護(hù)自己的利益。因此,在對(duì)待少年犯罪問題上,尤其是涉及財(cái)產(chǎn)的經(jīng)濟(jì)犯罪上,都給予最為嚴(yán)厲的懲罰,甚至處以極刑。到19世紀(jì)中下葉,隨著人道主義者、慈善家等的努力,人們逐漸改變對(duì)少年犯罪的懲罰,從以重刑處罰為主轉(zhuǎn)向以預(yù)防培養(yǎng)改造為主,著眼于矯治預(yù)防,而非嚴(yán)刑峻法�！�1908年兒童法》對(duì)成人犯罪與少年犯罪規(guī)定了量刑上的區(qū)別,放棄了以懲罰性處罰為主的刑事審判。從懲罰觀念、審判方式到審判法律的變化,反映了19世紀(jì)英國少年犯罪懲罰觀念的變遷,也在一定程度上反映了時(shí)代的變遷與文明的發(fā)展進(jìn)程。
[Abstract]:In 19 th century England, capitalism was a total victory, and they used every means to protect their own interests. Therefore, in the treatment of juvenile delinquency, especially the economic crimes involving property, the most severe punishment is given, and even the death penalty is imposed. By the middle and lower part of the 19th century, with the efforts of humanists and philanthropists, people gradually changed the punishment for juvenile delinquency, from heavy punishment to preventive cultivation and reform, focusing on correction and prevention. The Child Law of 1908 stipulates the difference in sentencing between adult delinquency and juvenile delinquency, and gives up the criminal trial with punitive punishment as the main punishment. The changes from the concept of punishment, the way of trial to the law of trial reflect the changes of the concept of punishment of juvenile delinquency in the 19th century, and to some extent, the changes of the times and the development of civilization.
