【摘要】：美國(guó)的少年司法制度經(jīng)歷了一個(gè)多世紀(jì)發(fā)展,其隨著美國(guó)的犯罪政策、少年政策變化而不斷更新。自上個(gè)世紀(jì)六七十年代以來(lái),隨著少年犯罪率上升,"嚴(yán)打"政策倡導(dǎo)對(duì)少年犯懲罰的回歸。因此,少年犯向成人刑事法院轉(zhuǎn)移成為了美國(guó)少年司法實(shí)踐中的一大特色,到九十年代達(dá)到巔峰。美國(guó)少年司法中少年犯轉(zhuǎn)移有三種基本類型,分析這幾種轉(zhuǎn)移模式在各個(gè)州的發(fā)展與變遷,結(jié)合其理論基礎(chǔ),進(jìn)一步解讀少年犯轉(zhuǎn)移的影響。
[Abstract]:The juvenile justice system in America has been developing for more than a century. Since the sixties and seventies of the last century, with the rise of juvenile crime rate, the "strike hard" policy advocates the return of juvenile delinquent punishment. Therefore, the transfer of juvenile offenders to adult criminal courts has become a major feature of juvenile justice practice in the United States, reaching its peak in the 1990s. There are three basic types of transfer of juvenile delinquents in American juvenile justice. This paper analyzes the development and changes of these transfer models in various states, and further interprets the influence of the transfer of juvenile offenders on the basis of their theoretical basis.
