對“以法治方式推進(jìn)改革”的解讀

摘是對法治與改革關(guān)系的重新定位。這既可提升要：以法治方式凝聚改革共識，進(jìn)而推進(jìn)改革的命題，

法治在政治、經(jīng)濟(jì)生活中的地位，也是下一步改革的指導(dǎo)思想。如何準(zhǔn)確地理解法治方式，進(jìn)而理

“轉(zhuǎn)型陷阱”，“結(jié)構(gòu)緊張”順法治與改革的關(guān)系，跳出改革的化解權(quán)利與權(quán)力之間的關(guān)系，是理論

“你治我”“我治你”法學(xué)的重要任務(wù)。法治方式不是或的工具，而是一種公共治理的理性思維決

策方式。改革與法治都是化解社會(huì)矛盾的危機(jī)處理方式，但無論哪一種方式的單獨(dú)運(yùn)用都可能會(huì)

出現(xiàn)偏差，因?yàn)橥母锘蜻^于猛烈的改革都可能會(huì)激化社會(huì)矛盾，而法治走向僵化不僅會(huì)放緩

改革的步伐，而且也可能強(qiáng)化固有的矛盾。中國既需要改革，也需要法治，改革必須在法治的框架

“以法治方式促進(jìn)改革”內(nèi)展開。我們需要在改革、法治與社會(huì)的三重關(guān)系中理解的意蘊(yùn)。

Abstract：Thepropositionaboutcondensingthereformconsensusbythewayoftheruleoflawandthenpromoting

thereformistherepositioningoftherelationshipabouttheruleoflawandthereform．Thisisnotonly

toenhancetheruleoflawinthepoliticalandeconomicposition，butalsothenextstepofreform＇s

guidingideology．Theimportanttaskofthetheoryoflawisthatunderstandingtheruleoflawandthen

straighteningtherelationshipabouttheruleoflawandthereform，avoidingfallingintothereformofthe

“transitiontrap”andresolvingthe“structuraltension”relationshipbetweenthepowerandtheright．

Theruleoflawisnotthetoolof“youruleme”or“Iruleyou”，butadecision-makingaboutrational

thinkingofpublicgovernance．Ｒeformandtheruleoflawarethewaysofresolvingsocialconflicts，but

theseparationofthetwowaysmaybringaboutdeviation，becausethestagnatedformandtheviolent

reformmayintensifysocialcontradictions．Therigidruleoflawwillnotonlyslowdownthepaceof
