“事改企”員工社保權(quán)益落實的研究

【摘要】:自1985年,黨中央發(fā)布一系列關(guān)于科教文衛(wèi)等事業(yè)單位改制決定,我國事業(yè)單位改制拉開了序幕。事業(yè)單位改制員工是我國事業(yè)單位改制過程中產(chǎn)生的新的群體,黨和國家一直關(guān)注、關(guān)心事業(yè)單位改制員工,近年來,出臺了一系列關(guān)于改制員工的社會保障的政策。2011年國務(wù)院辦公廳發(fā)布的《關(guān)于分類推進事業(yè)單位改革中從事生產(chǎn)經(jīng)營活動事業(yè)單位轉(zhuǎn)制為企業(yè)的辦法中》,對事業(yè)單位改革中的員工的社會保障做了清楚的規(guī)定,包括在養(yǎng)老保險、醫(yī)療保險、以及改制員工的安置方面,制度性的保障了改制員工的社保權(quán)益。在學(xué)術(shù)界,我國的專家學(xué)者對于事業(yè)單位改制員工的安置、社會保障權(quán)益也做了大量的研究。本文通過比較N市1992與2003年年事業(yè)單位改制員工的社會保障權(quán)益為切入點,通過在N市信訪接待中心收集的關(guān)于“事改企”退休員工的信訪案例為基礎(chǔ),了解N市1992年“事改企”員工的社會保障權(quán)益的基本情況。通過訪談與信訪事例相結(jié)合,得出1992年“事改企”員工在養(yǎng)老保險金、醫(yī)療保險金、喪葬補助金和績效工資等方面存在差距。繼而通過深入分析訪談內(nèi)容和相關(guān)的改制文件,得出1992年“事改企”退休員工權(quán)益受損的原因,包括改制政策不完善、改制程序不規(guī)范、改制員工信息獲取效率低。同時分析了1992年“事改企”退休員工為了維護自身的社會保障權(quán)益選擇的維權(quán)途徑,包括非正規(guī)途徑中的人際關(guān)系途徑、到市政府門前靜坐途徑;正式途徑中到政府途徑、司法途徑和傳媒途徑。其中,正式途徑包括上訪和座談會;傳媒途徑包括大眾傳媒和小眾傳媒兩個方面。在此基礎(chǔ)上分析各個維權(quán)途徑的效果,即正式途徑與非正式途徑的并未解決“事改企”員工的權(quán)益訴求,最終仍然需要從政府的公共政策層面解決此問題。最后,筆者給出“事改企”退休員工權(quán)益保障的建議,包括國家給予政策支持、員工選擇理性維權(quán)、非政府介入維權(quán);在公共政策調(diào)整期要實現(xiàn)政策有效銜接和完善政策的監(jiān)督。研究關(guān)于1992年“事改企”員工的社保權(quán)益受損與維護,可為我國其他地方事業(yè)單位改制員工的社會保障權(quán)益維護提供建設(shè)性建議,為我國事業(yè)單位改革的深入發(fā)展保駕護航,為社會主義市場經(jīng)濟的發(fā)展提供安穩(wěn)的環(huán)境,也為公共政策調(diào)整期的政策保障提供建議。
[Abstract]:Since 1985, the CPC Central Committee has issued a series of decisions on the reform of institutions such as science, education, culture and health, and the reform of institutions in China has begun. In recent years, the Party and the state have been paying close attention to and concerned about the employees in the reform of public institutions, which is a new group in the process of reforming institutions in our country. A series of policies on social security for restructured employees have been issued. In 2011, the General Office of the State Council issued the measures on the Transformation of production and Business activities into Enterprises in the Reform of Public institutions by Classification. The social security of employees in the reform of public institutions is clearly defined, including the old-age insurance, medical insurance, and the placement of restructured employees, and the institutional protection of the social security rights and interests of the restructured employees. In academia, experts and scholars in our country have done a lot of research on the placement and social security rights of employees in public institutions. Based on the comparison of the social security rights and interests of the restructured employees in 1992 and 2003 in N City, this paper is based on the letters and visits cases collected by the letter and visit reception Center in N City on the basis of the cases of retired employees of the "business-to-enterprise" system. Understand the basic situation of social security rights and interests of employees in 1992. Through the combination of interviews and letters and visits, it is concluded that there is a gap in pension insurance, medical insurance, funeral grant and performance wage among employees in 1992 in the area of old-age insurance, medical insurance, funeral grant and performance wage. Then through in-depth analysis of the contents of interviews and related reform documents, the reasons for the loss of the rights and interests of retired employees in 1992, including imperfect reform policy, irregular reform procedures, low efficiency of information acquisition of the reform staff. At the same time, this paper analyzes on the way to safeguard the rights of retired employees in 1992 in order to safeguard their social security rights, including the way of interpersonal relationship in the informal way, and the way to sit-in front of the municipal government. Formal channels to the government, judicial and media channels. Among them, formal channels include petitions and colloquiums; media channels include mass media and minority media. On this basis, the author analyzes the effect of various ways of safeguarding rights, that is, the formal approach and the informal approach have not resolved the rights and interests demands of the employees of the "incident-changing enterprise", and the problem still needs to be solved from the level of public policy of the government at the end of the paper. Finally, the author gives some suggestions on the protection of the rights and interests of retired employees, including the policy support given by the state, the rational protection of the employees' choice, and the involvement of the non-government in the protection of the rights; In the period of adjustment of public policy, it is necessary to realize effective policy convergence and perfect the supervision of policy. A study on the damage and maintenance of social security rights and interests of employees in 1992 can provide constructive suggestions for the maintenance of social security rights and interests of employees in the reform of public institutions in other parts of our country, and protect the in-depth development of the reform of institutions in China. To provide a stable environment for the development of socialist market economy, but also to provide suggestions for policy protection during the period of adjustment of public policy.
