中西文化對勘視閾中的禮法之辨——儒家的禮治傳統與基督教的法治傳統之比較

【摘要】:儒家對禮治的崇尚凸顯出中國"禮儀之邦"的特征,禮治作為儒家的傳統,成為其治理國家的重要方略。相比于儒家,基督教自創(chuàng)建以來,就彰顯出濃厚的法治色彩,經過悠久歷史的嬗變,法治逐漸內化為基督教的傳統。從中西文化對勘視閾中將基督教的法治傳統與儒家的禮治傳統進行比較研究,就會發(fā)現兩者具有旗幟鮮明的價值分野,主要體現在自律與他律,差級與平等,權力至上與法律至上,集權與限權四個方面。
[Abstract]:Confucianism advocates the rule of etiquette to highlight the characteristics of China's "ritual state", as a Confucian tradition, it has become an important strategy to govern the country. Compared with Confucianism, Christianity has been established since its establishment. Through the evolution of a long history, the rule of law is gradually internalized into the Christian tradition. From the perspective of Chinese and Western cultures, the Christian tradition of rule of law and the Confucian tradition of rule of etiquette are comparatively studied from the perspective of Chinese and Western cultures. It will be found that the two have a clear-cut distinction of value, mainly reflected in four aspects: self-discipline and heteronomy, difference and equality, supremacy of power and the supremacy of law, centralization and restriction of power.
