【摘要】：警察法治是法治中國的一部分,也是國家治理現(xiàn)代化的重要組成內(nèi)容。搞好警察法治建設(shè),首先要對警察法治理論內(nèi)涵、治理模式、踐行邏輯進(jìn)行充分論證,以回答警察法治是什么,我們要建成什么樣的警察法治以及如何去實(shí)現(xiàn)這種警察法治這三個(gè)前設(shè)問題。以平衡為場域,通過確定警察法治理論內(nèi)涵的研究視域、客體、導(dǎo)向,我們論證了警察法治理論內(nèi)涵的精髓是七對基本范疇的平衡。與平衡警察法治理論內(nèi)涵相匹配的是公共治理模式,它要求警察法治具有多元的主體構(gòu)成、開放的警務(wù)形式、雙向警察公共物品供給途徑、多重的權(quán)力分工協(xié)作結(jié)構(gòu)以及多樣的制度類型。此種治理模式需要我們踐行合作型警察法治,并且它有具體的表現(xiàn)形式、實(shí)現(xiàn)進(jìn)路和適用限度。
[Abstract]:The police rule of law is a part of the rule of law in China and an important component of the modernization of national governance. In order to do a good job in the construction of the police rule of law, we must first fully demonstrate the theoretical connotation, governance model and practice logic of the police rule of law in order to answer what the police rule by law is. What kind of police rule of law should we build and how to realize this kind of police rule? Taking balance as the field, we demonstrate that the essence of the theoretical connotation of the police rule of law is the balance of seven basic categories by determining the research horizon, object and orientation of the theoretical connotation of the police rule of law. The model of public governance, which matches the connotation of the theory of balancing the police rule by law, requires that the police rule by law has a pluralistic subject structure, an open form of policing, and a two-way approach to the supply of police public goods. Multiple power division and cooperation structure and various institutional types. This kind of governance mode needs us to practice the cooperative police rule of law, and it has the concrete manifestation, realizes the way and the applicable limit.
