【摘要】：在把馬克思主義基本原理同中國的具體實際、中國的歷史文化相結(jié)合,探索中國特色的社會主義道路的過程中,中國共產(chǎn)黨創(chuàng)造性地建立人民調(diào)解制度——一種解決民間糾紛頗具中國特色的政治法律制度。中國共產(chǎn)黨自從誕生之時起,就對人民調(diào)解工作進(jìn)行探索,人民調(diào)解是黨處理基層糾紛的一種主要的形式,對解決人民內(nèi)部矛盾,維護(hù)社會秩序,調(diào)動廣大人民群眾革命積極性起著舉足輕重的作用。新民主主義革命時期是黨探索人民調(diào)解取得輝煌成果的階段,人民調(diào)解從無到有,從局部地區(qū)推廣到全中國,從零散到漸成體系,為新民主主義革命的勝利做出不可磨滅的貢獻(xiàn)。黨領(lǐng)導(dǎo)的人民調(diào)解工作在發(fā)展演進(jìn)過程中,不斷取得卓越的成果,但是到了20世紀(jì)90年代,我國的人民調(diào)解出現(xiàn)某種程度的萎縮。我們研究新民主主義時期黨對人民調(diào)解工作的探索,是為了總結(jié)經(jīng)驗,以指導(dǎo)我們今天的法制建設(shè)以及各項工作。 革命戰(zhàn)爭年代,由于當(dāng)時黨領(lǐng)導(dǎo)的革命區(qū)域內(nèi)的社會生活中存在內(nèi)部矛盾和糾紛的現(xiàn)實,加之我國有悠久的調(diào)解傳統(tǒng)以及人民調(diào)解自身的優(yōu)勢使黨必然選擇人民調(diào)解的方式解決這些矛盾。新民主主義革命時期黨對人民調(diào)解工作的探索大致經(jīng)歷了四個階段:從黨的創(chuàng)立到大革命結(jié)束為第一個階段,在這一時期黨主要領(lǐng)導(dǎo)工農(nóng)運(yùn)動,為解決內(nèi)部矛盾和基層糾紛,在黨的領(lǐng)導(dǎo)下工農(nóng)組織嘗試接管調(diào)解權(quán),黨對人民調(diào)解工作的探索從此開始;到了土地革命時期,革命根據(jù)地政權(quán)對人民調(diào)解工作進(jìn)行進(jìn)一步的探索,人民調(diào)解工作常規(guī)化;抗日戰(zhàn)爭時期,黨對人民調(diào)解工作的探索取得豐碩的成果,在黨的領(lǐng)導(dǎo)下抗日根據(jù)地的人民調(diào)解工作進(jìn)一步法制化;伴隨著解放戰(zhàn)爭勝利的步伐,黨領(lǐng)導(dǎo)下的人民調(diào)解工作進(jìn)一步完善,并由區(qū)域分割的格局向全國統(tǒng)一性過渡。新民主主義革命時期黨探索人民調(diào)解工作的成功經(jīng)驗對我們搞好當(dāng)今時代的人民調(diào)解工作有啟迪作用,如人民調(diào)解工作要始終圍繞黨在一定時期的中心工作而展開,為實現(xiàn)黨的目標(biāo)而努力;并且在黨的領(lǐng)導(dǎo)下,要不斷完善人民調(diào)解的法律法規(guī),努力做到有章可循,有法可依;要建立一支把人民利益放在首位的人民調(diào)解員隊伍,提高調(diào)解效率;要與時俱進(jìn)地創(chuàng)新人民調(diào)解的工作方式,使黨的人民調(diào)解工作長盛不衰。

Since the birth of the Communist Party of China, it has been exploring the people's mediation work. People's mediation is a major form of the party's handling of disputes at the grass-roots level, and it has served to resolve contradictions among the people and to maintain social order. Mobilize the masses of the masses revolutionary enthusiasm plays a pivotal role. The period of the new democratic revolution was the stage in which the party explored the brilliant achievements of the people's mediation. The people's mediation began from scratch, spread from local areas to the whole of China, and gradually became a system from scattered to gradual. To make an indelible contribution to the victory of the new democratic revolution. In the process of development and evolution, the people's mediation led by the Party has made remarkable achievements, but in the 1990s, the people's mediation in our country has been shrinking to some extent. The purpose of our study of the Party's exploration of the people's mediation in the new democratic period is to sum up our experience and guide our legal system construction and all kinds of work today. During the revolutionary war years, due to the reality of internal contradictions and disputes in the social life in the revolutionary areas led by the Party at that time, In addition, our country has a long tradition of mediation and the superiority of the people's mediation itself, so the Party must choose the way of people's mediation to solve these contradictions. In the period of the New Democratic Revolution, the party's exploration of the people's mediation work has generally gone through four stages: from the founding of the Party to the end of the Great Revolution as the first stage, during which the Party mainly led the movement of workers and peasants, in order to resolve internal contradictions and disputes at the grass-roots level. Under the leadership of the Party, the workers' and peasants' organizations tried to take over the mediation power, and the party's exploration of the people's mediation began from then on. In the period of land revolution, the political power in the revolutionary base area made further exploration on the people's mediation work, and the people's mediation work was regularized. During the War of Resistance against Japan, the exploration of the people's mediation by the Party achieved fruitful results, and the people's mediation in the anti-Japanese base area was further legalized under the leadership of the Party. With the victory of the Liberation War, the people's mediation work under the leadership of the Party has been further improved, and the pattern of regional division has been transformed to the unity of the whole country. The successful experience of the Party in exploring people's mediation during the new democratic revolution has enlightening us in doing a good job in people's mediation in the present.For example, people's mediation should always be carried out around the party's central work in a certain period of time. To achieve the Party's goals; And under the leadership of the Party, we should constantly improve the laws and regulations of people's mediation, strive to have rules to follow, have laws to abide by, set up a contingent of people mediators who put the interests of the people in the first place, and improve the efficiency of mediation. We should keep pace with the times and innovate the working methods of people's mediation so that the party's people's mediation will last forever.
