【摘要】：17世紀(jì)后期至18世紀(jì)中期,英國經(jīng)歷了一場持久的婚配制度轉(zhuǎn)型。傳統(tǒng)婚配制度所維護(hù)的是神權(quán)、習(xí)俗及家長權(quán)威,婚配形式也沒有形成規(guī)范和統(tǒng)一。在新的社會背景下,舊式婚配制度逐步走向瓦解,而新制度的法制形成過程則長達(dá)大半個世紀(jì)。最終于18世紀(jì)中葉,英國在國家層面上建立起統(tǒng)一規(guī)范的婚配制度,婚配事務(wù)的裁定權(quán)也從教會手中轉(zhuǎn)至政府機(jī)構(gòu),實(shí)現(xiàn)從"神治"到法治的轉(zhuǎn)變,它是英國社會步入現(xiàn)代文明的重要標(biāo)志。
[Abstract]:From the end of the 17 th century to the middle of the 18 th century, England underwent a long-lasting transformation of the marriage system. The traditional marriage system maintains theocratic rights, customs and parental authority, and the form of marriage is not standardized and unified. In the new social background, the old marriage system gradually disintegrated, and the legal formation process of the new system lasted for more than half a century. Finally, in the middle of the 18th century, the United Kingdom established a unified and standardized marriage system at the national level, and the power of adjudication of matrimonial affairs was also transferred from the church to the government, thus realizing the transformation from the "divine rule" to the rule of law. It is an important symbol of modern civilization in British society.
