石羊河流域生態(tài)環(huán)境保護(hù)的法治困境及其治理對策

【摘要】： 由于特殊的地理位置條件,石羊河流域是我國西北地區(qū)的重要“生態(tài)門戶”。目前,流域水資源開發(fā)利用已嚴(yán)重超過其承載能力,致使流域生態(tài)環(huán)境日趨惡化,危害程度和范圍日益擴(kuò)大。本文以石羊河流域水資源管理和生態(tài)保護(hù)作為研究對象,從石羊河流域法制治理的角度出發(fā),研究了目前流域水資源管理及生態(tài)保護(hù)立法中存在的一些問題,并提出了自己的若干建設(shè)性意見。以期在可持續(xù)發(fā)展思想的指導(dǎo)下,以生態(tài)為本位,逐步建立和完善國家與地方環(huán)境資源立法,在石羊河水資源管理和生態(tài)保護(hù)中更好地發(fā)揮法的規(guī)范、指引、強(qiáng)制、教育等作用,最終實(shí)現(xiàn)人與自然的和諧共處。 本文正文內(nèi)容主要分為四部分: 第一部分內(nèi)容涉及石羊河流域的概況。這一部分主要對石羊河流域水資源利用及生態(tài)環(huán)境的現(xiàn)狀進(jìn)行了介紹,為下面的理論分析做好必要鋪墊。 第二部分介紹了石羊河流域治理的立法現(xiàn)狀,對當(dāng)前立法中存在的問題進(jìn)行了梳理,并指出相關(guān)法律法規(guī)和政策措施在具體執(zhí)行過程中遇到的問題。同時(shí),還分析了流域水資源管理和生態(tài)環(huán)境保護(hù)的體制障礙。 第三部分主要為石羊河流域生態(tài)保護(hù)的理論基礎(chǔ)。首先,從可持續(xù)發(fā)展觀念的內(nèi)涵著手,指出應(yīng)從可持續(xù)發(fā)展角度開發(fā)利用水資源,促進(jìn)生態(tài)保護(hù)。其次,以著名文明崩潰的歷史教訓(xùn)為鑒,提出地緣生態(tài)學(xué)的概念,即把地理要素看作是決定生態(tài)環(huán)境的一個(gè)基本因素。最后,介紹了石羊河流域上游的山丹(軍)馬場沒有遵守生態(tài)規(guī)律、不當(dāng)利用資源而導(dǎo)致生態(tài)危機(jī)。 第四部分是對石羊河流域生態(tài)治理中法律完善和制度建構(gòu)上的思考。首先,提出完善立法的建議;其次,是對流域治理執(zhí)法模式的思考;最后,從生態(tài)補(bǔ)償和生態(tài)移民上探討石羊河流域治理的制度供給。
[Abstract]:Due to special geographical location, Shiyang River Basin is an important ecological gateway in Northwest China. At present, the exploitation and utilization of river basin water resources have exceeded its carrying capacity seriously, resulting in the worsening of ecological environment and the increasing harm degree and scope of the basin. In this paper, water resources management and ecological protection in Shiyang River Basin are taken as research objects, and some problems existing in the legislation of water resources management and ecological protection in Shiyang River Basin are studied from the perspective of legal management in Shiyang River Basin. Some constructive suggestions are put forward. With a view to establishing and perfecting the national and local legislation on environmental resources under the guidance of the sustainable development thought and taking the ecology as the standard, we can bring the law into full play in the management of water resources and ecological protection of Shiyang River. Education, and so on, finally realizes the harmonious coexistence between man and nature. The main body of this paper is divided into four parts: the first part involves the general situation of Shiyang River Basin. This part mainly introduces the current situation of water resources utilization and ecological environment in Shiyang River Basin, which is necessary for the following theoretical analysis. The second part introduces the current legislative situation of Shiyang River basin management, combs the existing problems in the current legislation, and points out the problems encountered in the implementation of relevant laws, regulations and policies. At the same time, the system obstacles of water resources management and ecological environment protection are analyzed. The third part is the theoretical basis of ecological protection in Shiyang River Basin. Firstly, from the connotation of the concept of sustainable development, it is pointed out that water resources should be developed and utilized from the angle of sustainable development to promote ecological protection. Secondly, based on the historical lessons of the collapse of famous civilization, this paper puts forward the concept of geo-ecology, that is, the geographical elements are regarded as a basic factor to determine the ecological environment. Finally, the ecological crisis caused by improper utilization of resources in Shandan (military) racetrack in the upper reaches of Shiyang River basin is introduced. The fourth part is thinking about the perfection of law and the construction of system in the ecological management of Shiyang River Basin. Firstly, it puts forward some suggestions to perfect the legislation; secondly, it thinks about the law enforcement mode of watershed management; finally, it probes into the system supply of Shiyang River basin management from ecological compensation and ecological migration.
