【摘要】： 檔案作為人類社會活動的真實(shí)記錄,是黨和國家的寶貴財富,是管理國家和開展各項(xiàng)工作的重要依據(jù)。檔案法制,通常指國家關(guān)于管理檔案事務(wù)的法律和制度,它是國家機(jī)關(guān)和公民為實(shí)現(xiàn)依法治檔,根據(jù)憲法和法律所賦予的職權(quán)而進(jìn)行的檔案立法、檔案行政執(zhí)法、檔案行政執(zhí)法監(jiān)督、檔案行政復(fù)議、檔案普法各項(xiàng)活動的基礎(chǔ)。檔案立法在檔案法制建設(shè)中占據(jù)主導(dǎo)位置。本文重點(diǎn)對我國檔案立法建設(shè)的歷史發(fā)展及其原因進(jìn)行分析。 新中國的檔案法制建設(shè)可以分為四個發(fā)展階段：1949年至1966年為初創(chuàng)和建設(shè)階段、1966年至1976年為遭受破環(huán)階段、1977年至1987年為恢復(fù)和全面發(fā)展階段、1987年至今為不斷修正和完善階段。本文主要運(yùn)用歷史分析和實(shí)證研究的方法,通過建國后頒布的檔案法規(guī)文件,介紹建國后每個階段檔案法制建設(shè)的內(nèi)容及發(fā)展歷程,并從經(jīng)濟(jì),政治、文化、科技的角度分析我國檔案法制發(fā)展變化的原因。最后總結(jié)分析當(dāng)前我國檔案法制建設(shè)存在的不足,針對現(xiàn)階段檔案法制建設(shè)存在的問題,提出若干參考性建議。
[Abstract]:As a true record of human social activities, archives are the precious wealth of the Party and the country, and the important basis for managing the country and carrying out all kinds of work. Archives legal system usually refers to the laws and systems of the state concerning the management of archival affairs. It is the archival legislation and administrative enforcement by state organs and citizens according to the functions and powers conferred by the Constitution and the law in order to realize the administration of archives according to the law. Supervision of archives administrative law enforcement, review of archival administration, and basis of various activities of archives popularization of law. Archives legislation occupies a leading position in the construction of archives legal system. This paper focuses on the historical development and reasons of archives legislation construction in China. The construction of archives legal system in New China can be divided into four stages: from 1949 to 1966, from beginning to construction, from 1966 to 1976, from 1977 to 1987, from the stage of restoration and comprehensive development. Since 1987, it has been revised and perfected continuously. By means of historical analysis and empirical research, this paper introduces the contents and development course of archives legal system construction in every stage after the founding of the people's Republic of China by means of archives laws and regulations issued after the founding of the people's Republic of China, and from the aspects of economy, politics and culture. From the angle of science and technology, the reasons for the development and change of archives legal system in China are analyzed. Finally, this paper summarizes and analyzes the shortcomings of the legal construction of archives in our country, and puts forward some suggestions for reference in view of the problems existing in the construction of the legal system of archives at the present stage.
